32 | Regarding allegation (2) Day care child sustained injury due to staff neglect or physical abuse, LPA observed teachers providing supervision during indoor/outdoor time with the children in care. Staff demonstrated age-appropriate interactions with children in care. All six (6) staff interviewed provided consistent statements about the facility’s care and supervision policy, as well as positive guidance and re-direction. All six (6) staff interviewed provided consistent statements about aiding children during injuries and providing medical treatment, if necessary. Two (2) out of two children did not qualify to be interviewed. All two (2) interviewed parents did not disclose any concerns regarding the allegation. During record review, LPA Castro examined the facility’s Enrollment Agreement, Parent Handbook (Parent Essentials), Accident/Injury Reports and Observations Reports and other relevant documents.
The Orange County Regional Child Care Licensing Office has investigated the complaint alleging (1) Staff does not report incident to day care child’s representative party in a timely manner, and (2) Day care child sustained injury due to staff neglect or physical abuse. Based on the information gathered from LPA’s interviews and record reviews, although the allegation may have happened or is valid, there was not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.
In the areas that were evaluated, no deficiencies were observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit.
Appeal Rights were explained. The Licensee was provided a copy of appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above. A notice of site visit was given and must remain posted for 30 days.
