On 06/21/2024, Licensing Program Analyst (LPA) Romy Castanon made an unannounced visit to the facility to deliver findings of a complaint that was received at the Orange County Regional Child Care Program Office. LPA arrived at 8:55am and entered the facility at 9:08am. LPA later met with Office Administrator Binbin “Vicky” Zhao and explained the reason for today’s visit. Observed at the time of the visit was a total of eight (8) children and two (2) staff.
A review of the Facility Personnel Report Summary on 06/21/2024 indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 03/26/2024, the Regional Office received a complaint report alleging staff commingle infants with preschool children. Complaint stated upon morning drop off around 7:30am on 03/25/2024, there were two (2) infants being cared for in the “primary room” with the preschool age children arriving. Reporting Party did not provide contact information so no further details could be obtained. (Continue to page 2)

LPA conducted a visit on 03/29/2024 and interviewed 4 staff members. During the interview with staff, 2 out of 4 staff disclosed incidents of how the facility commingles children. Staff #2 (S2) recalled two (2) infants being in the preschool classroom for 15 minutes. Staff #3 (S3) recalls incidents of infants and preschool commingling upon opening until other staff arrived. 3 out of 4 staff members stated the facility commingles the children due to a recent issue of low staffing.

During secondary visit on 04/10/2024, LPA interviewed 3 children, but no disclosures were made. On 06/04/2024, LPA interviewed 3 out of 5 parents. Parents did not provide information pertinent to the complaint allegation.

Based on LPA’s interviews, the preponderance of evidence standard has been met, therefore the above allegation staff commingle infants with preschool children is substantiated. California Code of Regulations, Title 22, Division 12, 101161(a) Limitations on Capacity and Ambulatory Status is being cited on the attached LIC9099D.

Exit interview was conducted with Office Administrator Binbin “Vicky” Zhao. The Notice of Site Visit was posted. Facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalty of $100. Director was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days.

Upon receipt, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. Licensee shall have LIC9224 (Acknowledgement of Receipt) signed and kept in each child's file.

Office Admin Vicky Zhao stated the programs do not commingle. The facility offers an extended day program for both licenses and staffing is scheduled based on arrival times. Admin stated they would create an actual plan to ensure there is no commingling of children during operational hours by the POC date.

Based on LPA’s staff interviews, the facility was commingling infant and preschool children due to staffing issues. This poses an immediate health, safety or personal rights risk to persons in care.
