On 01/06/2026, Licensing Program Analyst (LPA) Kathy Trinh conducted an unannounced complaint visit to deliver the complaint findings. This is a continuation of the investigation initiated on 10/23/2025. LPA Kathy Trinh met with Director Angie Lozano, who led LPA on a tour of the facility. At the time of the investigation, a total of eight (8) infant children with three (3) staff members; ten (10) toddler children with one (1) staff member; and eighteen (18) preschool children with one (1) staff member observed during nap time.

A review of staff criminal clearance records on this date, 01/06/2026, indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 10/19/2025, the Orange County Child Care Office received a complaint alleging that (1) Staff handle day care children in a rough manner. (2) Staff yelled at day care children. (3) Staff leaves daycare child in highchair for extended periods of time. (4) Staff leaves day care children soiled for extended periods of time. (5) Staff does not provide adequate meal service.

During the investigation, LPA conducted facility visits on 10/23/2025. LPA Trinh interviewed five (5) staff members and five (5) parents. LPA did not interview the infant children due to their age being too young and not being qualified. LPA Trinh also reviewed records, including the LIC 500 Personnel Report, LIC 9040 Children’s Roster, Infant/Toddler staff members' timesheet from 9/29/2025 to 10/3/2025, Parents' Handbook, and Infant/Toddler Daily Log for children as of the day of visit 10/13/25. Infant/Toddler for infant sleep observation (15 mins from 10/6/2025 through 10/10/2025).

Regarding the allegation (1), “Staff handles day care children in a rough manner.” During visits on 10/23/25. LPA observed each infant and toddler classroom; LPA did not observe any staff handling children in a rough manner. LPA interviews five (5) staff members; all staff members shared understanding of children’s rights and have received personal rights training. Five (5) of five (5) staff members did not disclose any information related to the allegation. All five (5) interviewed parents did not disclose any information related to the allegation.

Regarding allegation (2), “Staff yelled at day care children”. During the visit on 10/23/25, from 3:30 p.m. to 4:15 p.m., an observation was conducted in the classroom. In the infant classroom, the LPA observed four (4) infants playing and singing in the baby area with two (2) staff members nearby. Staff were observed interacting appropriately and used gentle voice with the children in care. During staff interviews, all five (5) staff members did not disclose any information related to the allegation. All five (5) interviewed parents did not disclose any information related to the allegation.

Regarding the allegation (3), “Staff leaves daycare child in highchair for extended periods of time.” During the visit on 10/23/25, from 3:30 p.m. to 4:15 p.m., an observation was conducted in the classroom. In the toddler classroom, the LPA observed five (5) toddlers in highchairs eating snacks with two (2) staff members nearby.

The LPA observed two (2) of the five (5) toddlers using sign language to say “all done” to signal to the staff. One (1) of the two (2) staff members near the child responded with the sign language “you are done” and then allowed the child to get up. During staff interviews, all five (5) staff members did not disclose any information related to the allegation. All five (5) interviewed parents did not disclose any information related to the allegation.

Regarding allegation (4), “Staff leaves day care children soiled for extended periods of time.” During the visit on 10/23/25, around 12:00 noon, the LPA observed that some infants' cubbies contained dirty clothes wrapped in plastic bags and placed inside the cubbies. During record review, LPA obtained and reviewed the infants' daily logs. In each daily log, there are records of diaper changes, including the time and specific notes indicating whether the diaper was dry, wet, or has a bowel movement (BM), along with the check times, which occur every half hour. If a child gets wet or soiled, the teacher documents the time and notifies the appropriate staff. During staff interviews, all five (5) staff members did not disclose any information related to the allegation. All five (5) interviewed parents did not disclose any information related to the allegation.

Regarding allegation (5), “Staff does not provide adequate meal service.” During the visit on 10/23/25, from 3:30 p.m. to 4:15 p.m., an observation was conducted in the classroom. In the toddler classroom, the LPA observed five (5) toddlers in highchairs eating snacks with two (2) staff members nearby. The LPA observed that the five children were sitting in highchairs and using sign language to ask for more food. The teacher nearby repeated the foods the children requested and served them accordingly. During staff interviews, all five (5) staff members did not disclose any information related to the allegation. All five (5) interviewed parents did not disclose any information related to the allegation.

Based on observations, interviews, and record reviews, there is not a preponderance of evidence to prove that the (1) Staff handle day care children in a rough manner, (2) Staff yelled at day care children, (3) Staff leaves daycare child in highchair for extended periods of time, (4) Staff leaves day care children soiled for extended periods of time, and (5) Staff does not provide adequate meal service. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the allegations did or did not occur in the day-care facility; therefore, the listed allegations are UNSUBSTANTIATED.

An exit interview was completed. The report was reviewed and discussed. Appeal Rights were provided. The Director, Angie Lozano, was provided a copy of their appeal rights. The Director, Angie Lozano, was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00.
