On 08/19/26, Licensing Program Analyst (LPA) Vivian Trinh conducted an unannounced complaint visit to deliver the findings of the complaint. This is a continuation of the investigation initiated on 7/20/2026. LPA Trinh met with Owner/Licensee Maria Tejeda-Ruiz, who led LPA on a tour of the facility. At the time of the investigation, LPA Trinh observed six (6) infants and two (2) staff members; 11 toddlers and two (2) staff members; and 18 preschool children and two (2) staff members. Around 9:33 am, Director Lozano, Angie, arrived and assisted the LPA. LPA informed Director Lozano, Angie, of the purpose of the visit.

A review of staff criminal clearance records on this date, 08/19/26, indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 07/17/2026, the Orange County Child Care Office received a complaint alleging that (1) Wrongful dismissal of child (2) retaliation against parent or child.

During the investigation, LPA conducted facility visits on 07/20/2026. LPA Trinh interviewed three (3) staff members and five (5) parents. LPA Trinh also reviewed records, including the LIC 500 Personnel Report, the LIC 9040 Children’s Roster, Acknowledgment of Policies Signature Page from Child #1 (C1’s), Behavior Contract (Probation/Warning Letter dated 6/29/2026) from C1’s, Records of conversations with parents regarding discussions about behavior meetings from C1’s, Behavior Reports from C1’s. Picture of the Child #3 (C3): Remind app from parent to teacher got disconnected.

Regarding Allegation 1, “Wrongful dismissal of child,” the LPA conducted a site visit on 07/20/2026 and interviewed three (3) staff members. All staff interviews revealed that all staff had been communicating with C1’s parents and had arranged conferences and meetings regarding C1’s behavior. A review of the parent handbook (pages 10 and 11) indicates that “parents may request a special conference with the director and teacher”, and that “regular conferences are scheduled to discuss a child’s behavior or concerns”. The handbook further states that “continued misbehavior may result in dismissal from the school”. All five (5) interviewed parents did not disclose any information related to the allegation.

Regarding Allegation 2, “Retaliation against parents or child,” the LPA conducted a site visit on 07/20/2026 and interviewed three (3) staff members. Staff 1 (S1) stated that they became aware that Child #3 (C3) had been removed from the Remind communication app used between teachers and parents. S1 explained that the app registers accounts based on child enrollment sequence, and because C3’s family has older siblings who recently graduated, C3 may have been unintentionally removed from the communication list. S1 reported that on 7/16/2026, C3’s parents contacted the facility to address the issue. S1 assisted the parents and reconnected C3 to the Remind communication list on the same day, 7/16/2026, at 2:49 pm. Documentation provided to the LPA confirmed the date and time C3 was reinstated. According to the record review of the Remind app, S1 provided documentation to the LPA showing the date and time when C3 was reinstated in the system. Staff 2 (S2) and Staff 3 (S3) also stated that they had been providing updates and communicating with C3’s parents during drop off times regarding C3’s day, while the Remind app issue occurred and C3 was accidentally removed from the communication list. All five (5) interviewed parents did not disclose any information related to the allegation.

Based on observations, interviews, and record reviews, there is not a preponderance of evidence to prove that the (1) Wrongful dismissal of child, (2) Retaliation against parents or child. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the allegations did or did not occur in the day-care facility; therefore, the listed allegations are UNSUBSTANTIATED.

An exit interview was completed. The report was reviewed and discussed. Appeal Rights were provided. The Director, Lozano Angie, and the Owner/Licensee, Maria Tejeda-Ruiz, were provided a copy of their appeal rights. The Director, Lozano Angie, and the Owner/Licensee, Maria Tejeda-Ruiz, were informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00.
