On 02/02/20206, Licensing Program Analyst (LPA), V. Trinh, conducted an on-site inspection for the purpose of an Annual Random. At 1:00 pm upon arrival, LPA met with Site Supervisor White, Shanice. LPA toured the facility inside and outside the floor and yard plan (LIC 999). The census was taken in the toddler classroom. Room 18 with 5 toddlers, with 2 staff members. Room 20 with 5 toddlers, with 2 staff members napping. Site Supervisor stated the total enrollment is 14 toddler children, and they cannot exceed the capacity ratio of 24 children at any one time.

During the inspection, it was determined that the facility is operating within its licensed capacity and within compliance with staffing ratios. Facility hours are 7:00 am to 6:00 pm Monday through Friday. The facility is located on Clinton Corner Family Campus, and this facility is a state and federally funded HeadStart Program.

CRIMINAL RECORD CLEARANCE: A review of the Facility Personnel Report Summary on this date, 02/02/20206. The Director/or Facility representative understands that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption or transfer their existing clearance or exemption prior to the initial presence in a licensed childcare facility. Violation of this requirement will result in a citation of a deficiency and civil penalties of one hundred dollars ($100) per violation per day for a maximum of five (5) days. Subsequent violations within a twelve (12) month period will result in a civil penalty of one hundred dollars ($100) per violation per day for a maximum of thirty (30) days in accordance with Section 1596.871 of the Health and Safety Code.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

INDOOR INSPECTION. During the inspection of the indoor activity space, items that could pose a danger to children (detergents, cleaning compounds, and medications) were observed to be stored out of the reach of children. Poisons/Hazardous Items are not kept on the premises. Floors, equipment, and furniture were clean and were observed to be in good repair and free of sharp edges. There is drinking water available to children indoors in water bottles with the child’s name on it. The facility does practice potty training in the facility . The toddler napping area had individual cots . Toddler changing tables have a padded surface no less than one inch thick and are covered by washable vinyl/plastic, which is within arm’s reach of a hand-washing sink. Toddler changing tables have raised sides at least three inches high. A baby walker is not allowed on the premises of a childcare center. The facility has conducted an emergency drill within the past six months, 1/29/26. The facility has a working carbon monoxide detector and fire extinguisher. The facility met all posting requirements. The California Child Passenger Safety Law was posted at the entrance of the facility.

ON-SITE FOOD PREPARATION: Food gets delivered via GALB and staff prepared and separate the food on-site; Morning snack, lunch and afternoon snacks are provided. Trash receptacles containing solid waste have tight-fitting lids. Food prep areas were clean and sanitary. Food is properly stored. Menus are posted where they can be reviewed by parents.

OUTDOOR INSPECTION: The outdoor activity space was inspected for compliance. The playground was enclosed by a fence at least more than 5 feet in height. The surface of the outdoor activity space was well maintained and free of hazards. The cushioning material, grass commercially produced for the purpose of the climbing equipment, and crawling for toddler appeared to be enough to absorb falls. Drinking water in the outdoor activity space is provided by arrowhead water jug and disposable cups. The outdoor equipment and toys were in good repair and free of sharp edges. There are no bodies of water present at the facility. The facility grounds were safe, sanitary, and in good repair.

PERSONNEL RECORDS. Staff files were reviewed for staff present during the facility inspection on this date 02/05/20206, 4 staff files were reviewed. Health screening and immunization's as required were reviewed. Beginning September 1, 2016, Health and Safety (H&S) 1597.622 states that a person shall not be employed or volunteer at a childcare center if he or she has not been immunized against influenza, pertussis, and measles. Proof of immunization against pertussis and measles for infant staff was reviewed and in compliance. Continued page 3.

The Site Supervisor was informed that Licensing Quarterly Updates are available at www.ccld.ca.gov. The director may request to be added to an email list to receive a Quarterly Update by contacting the Child Care Advocate at childcareadvocatesprogram@dss.ca.gov or at www.ccld.ca.gov. LPA provided Guardian Information and

website info: https://www.cdss.ca.gov/inforesources/cdss-programs/community-care-licensing/caregiver-background-check/guardian

Information on the additional nutrition training, immunization requirements for children, and Health Schools Act (http://www.cdpr.ca.gov/docs/pestmgt/schoolipm.htm) was provided. The director was informed, and website given, about the California Child Care Disaster Plan has been posted to the UCSF California Childcare Health Program website: cchp.ucsf.edu/content/disaster-preparedness. Also provided was information about the E-Learning Modules available at https://ccld.childcarevideos.org. A copy of the California Department of Social Services Lead Information Brochure was explained and provided to the facility representative. Facility Director signed up to take the lead training 7/8/21.

LPA discussed the safe sleep regulations with the Site Supervisor and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed the Site Supervisor of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended that they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

The Site Supervisor was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.
