The Reporting Party (RP) stated that a child was observed with bruising on the child’s arm resembling possible finger marks, swelling and redness around the eye area, and dried blood in the child’s nose. Additionally, the RP expressed suspicion that children may not be receiving adequate diaper changes, as diaper rashes were observed.
As part of the investigation, LPA Lucero conducted interviews with staff members and parents.
Staff interviewed denied the allegations. They reported that they have not observed children with unexplained bruising, nor have they witnessed staff handling children in a manner that could cause such injuries. Staff further stated that diapers are changed frequently and checked every two hours or as needed, and when diaper rashes are present, diaper rash cream is applied to the affected area. Staff denied knowledge of any employees failing to change diapers appropriately.
Parents interviewed reported no concerns regarding the day care.
LPA attempted to interview children, however, they were not qualified for interviews.
Based on the information obtained during the investigation, there is no preponderance of evidence to support the allegations that (1) day care child sustained multiple injuries due to staff neglect and (2) staff do not ensure day care child's diapering needs are met. Although the allegations may have occurred or may be valid, there is insufficient evidence to determine whether the alleged violations did or did not occur. Therefore, the allegations are determined to be Unsubstantiated.
Exit interview was conducted with Area Director Chamila Gardiwasanr and Assistant Director Bianca Franco. The Notice of Site Visit was posted.
