Licensing Program Analyst (LPA) Kimberly Lyman made an unannounced complaint visit to deliver findings on the above allegation. LPA was greeted and granted entry by Director of Clinical Services Cara Deiro and explained the reason for the visit.

During the course of the investigation, LPA toured the facility, interviewed staff and witness as well as reviewed and obtained pertinent documentation such as physician report and home health notes. Regarding the allegation that facility is not following resident's care plan, the investigation revealed the following: per physician report dated 07/21/2021, Resident 1 (R1) is diabetic, an amputee, and on renal dialysis. R1 has had a documented ongoing issue with wounds. The resident was sent out to the hospital on 07/05/2022 for a necrotic second toe with foul odor. Resident returned to the facility on 07/08/2022. Per facility documentation, toe amputation was denied by family and resident. On 07/14/2022, Home Health nurse wrote an order on the progress notes for required daily Betadine paint on the toes afflicted. Facility states requiring a written physician order and CONTINUED ON LIC 9099C DATED 10/19/2023

Based on interviews conducted and record review, Licensee failed to ensure care and supervision was being provided to residents in care. Facility failed to follow R1's care plan regarding the care of necrotic toes. This poses an immediate health and safety risk to residents in care.

During the course of the investigation, LPA toured the facility, interviewed staff and witness as well as reviewed and obtained pertinent documentation such as physician report and home health notes. Regarding the allegations that resident was found left in feces on multiple occasions while in care, resident sustained pressure injuries while in care, and facility is retaining a resident requiring a higher level of care, the investigation revealed the following: Per Home Health documentation, R1 was observed to be soiled upon Home Health arrival to see R1 on 07/14/2023. Per caregiver tasks list, caregivers are instructed to check and change the resident four times per shift. Six out of six caregivers indicate changing the resident as required and state resident was not left soiled. R1 has a history of pressure injuries dating back to 2019. injuries from 02/2019-04/2019 and 07/2021-07/2022. Home Health was providing wound care for pressure injury on the buttocks as well as necrotic toes. Depending on the month, R1 was being seen by Home Health 1-4 times a month for wound care. Resident is diabetic, an amputee, and on renal dialysis and had been since admission. Per witnesses, R1 is non-compliant with care. Facility and Home Health indicate conversations with family regarding a higher level of care but was met with resistance. Due to conflicting information, LPA is unable to corroborate the allegations. Therefore, the allegations are deemed unsubstantiated, meaning that although the allegations may have happened or are valid, there is not a preponderance of the evidence to prove that the alleged violations occurred. An exit interview was conducted and a copy of this report was provided.

did not follow up with the physician for a written order until 07/18/2022. Additional Home Health documentation indicated the toes had not been attended to and stated the sock was soiled and smelly. Based on record review and interviews conducted, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 6, Chapter 8), are being cited on the attached LIC 9099D. An exit interview was conducted and a copy of this report was provided as well as appeal rights.
