On January 21, 2026, Licensing Program Analyst (LPA) Brandon Lopez made an unannounced visit to the facility to deliver the complaint findings. LPA was greeted and granted entry into the facility by staff after explaining the purpose for the visit. Administrator (AD) Arnold Andal was notified via telephone and later arrived to assist with the inspection.

During the course of the investigation, the Department interviewed clients, interviewed staff, reviewed and obtained pertinent documents to the complaint. Regarding the allegation, Licensee did not provide resident with a reappraisal, the following has been concluded: The Department conducted an interview with the Licensee. The Licensee denied the allegation and stated that reappraisals, and all other records, are provided to client's families when requested. The Licensee denied ever failing to provide a reappraisal to a client. The Department conducted an additional five staff interviews. Five out of the five staff interviewed denied the allegation and stated that records have been provided to clients families when requested. CONTINUED ON LIC9099-C

Regarding the allegation, resident sustained unexplained bruising while in care, the following has been concluded: It was alleged that Client #1 (C1) sustained unexplained bruising while in care. The Department was unable to conduct an interview with C1 for this complaint due to C1 moving out of the facility on November 4, 2022. The Department attempted to speak with C1's conservator, however, they declined to be interviewed. The Department conducted six staff interviews. Five out of the six staff interviewed denied the allegation and stated that they were unaware of C1 developing any unexplained bruising. The staff interview stated that the bruising could have been a result of a fall C1 sustained while at the facility. However, the staff also stated that each fall was documented, reported to the appropriate parties, and that medical attention was sought for C1 when needed. One of the six staff interviewed was unable to provide any information for this allegation due to the staff not being an employee during the time.

Regarding the allegation, staff did not address resident's change in condition while in care, the following has been concluded: It was alleged that staff did not address C1 change in condition while in care. The Department was unable to conduct an interview with C1 for this complaint due to C1 moving out of the facility on November 4, 2022. The Department conducted six staff interviews. One of the six staff interviewed was unable to provide any information for this allegation due to the staff not being an employee during the time. However, five out of the six staff interviewed denied the allegation and stated that C1's change of condition was addressed appropriately. The staff interviewed confirmed that C1 did have a change of condition while in care, but, these changes were documented, and reported to C1's conservator. The staff interviewed stated that the changes in C1's condition made him no longer appropriate for the facility, and as a result, C1's conservator was provided with a 30-day eviction notice. The Department attempted to speak with C1's conservator, however, they declined to be interviewed. The Department reviewed C1's file. The Department observed that C1's conservator was provided with 30-day eviction notices on January 18, 2021, June 9, 2021, June 27, 2021, July 9, 2021, September 20, 2021, and October 4, 2022. The Department observed that each of the 30-day eviction notices that were provided to C1's conservator cited that C1's needs could no longer be met by the facility, due to the changes in his condition.

Regarding the allegation, staff did not seek medical attention for resident in a timely manner, the following has been concluded: It was alleged that staff did not seek medical attention for C1 in a timely manner. The Department was unable to conduct an interview with C1 for this complaint due to C1 moving out of the facility on November 4, 2022. The Department conducted six staff interviews. Five out of the six staff interviewed denied the allegation and stated that the facility had a protocol on when to call 9-1-1 for C1 when he had seizures. CONTINUED ON LIC9099-C

The staff interviewed stated that this protocol was due to orders given by C1's neurologist regarding his seizure condition. The Department reviewed C1's file and observed that there was an order by C1's neurologist on January 17, 2022, which stated that staff were to administer C1's prescribed diazepam medication when C1 had a seizure greater than thirty seconds. It also stated that staff were to call 9-1-1 if C1 experienced a second seizure greater than thirty seconds. The staff interviewed stated that these orders were followed and that medical attention was always sought for C1 when needed. One of the six staff interviewed was unable to provide any information for this allegation due to the staff not being an employee during the time.

Regarding the allegation, staff emotionally abused resident in care, the following has been concluded: It was alleged that staff emotionally abused C1. The Department was unable to conduct an interview with C1 for this complaint due to C1 moving out of the facility on November 4, 2022. The Department conducted six client interviews. Five out of the six clients interviewed denied the allegation and stated that staff have never been mean to them. One out of the six clients interviewed was unable to provide a statement for this allegation due to the client being non-verbal. The Department conducted six staff interviews. Five out of the six staff interviewed denied the allegation and stated that staff were never emotionally abusive to C1. One of the six staff interviewed was unable to provide any information for this allegation due to the staff not being an employee during the time.

Regarding the allegation, staff did not respond to requests for communication about resident in care, the following has been concluded: It was alleged staff did not respond to requests for communication about C1. The Department attempted to speak with C1's conservator, however, they declined to be interviewed. The Department conducted six staff interviews. Five out of the six staff interviewed denied the allegation and stated that all communications were responded to regarding C1. One of the six staff interviewed was unable to provide any information for this allegation due to the staff not being an employee during the time.

Based on the evidence gathered during the investigation, the Department is unable to ascertain if the allegations occurred as reported. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove or refute the alleged violation occurred; therefore, the six allegations are deemed UNSUBSTANTIATED. An exit interview was conducted with Administrator Arnold Andal and a copy of the report was provided.
