Licensing Program Analyst (LPA) Luis Mora conducted a subsequent complaint visit in response to the above mentioned allegation. LPA met with Anna Marie Tomilloso (Co-Administrator) and explained the reason for the visit.

Investigation consisted of the following: On 09/21/2022, LPA Mora requested copies of client and staff rosters, copies of Client 1 (C1) physician report, Individual Personalized Plan (IPP), behavior assessment, admission agreement, face sheet, house rules and incident reports, and copies of Staff 1 (S1) entire file. LPA conducted a tour of the facility and common areas. LPA observed a sufficient supply of perishable and non-perishable foods. LPA observed the clients to identify any signs of neglect, abuse, or other immediate health and safety threats. LPA did not observe any immediate health and/or safety concerns. On 09/20/2022, this allegation was assigned to an Investigation Branch (IB) Investigator to complete the investigation, but due to the information gathered the Investigation Branch did not upgrade the case to full investigation and returned the case to the Regional Office for LPA Mora to complete the investigation.

During today's visit, LPA Mora obtained copies of resident and staff rosters, Client 1 (C1) Individual Program Plan (IPP), and reviewed C1's behavior notes. LPA also interviewed Licensee, Staff 1 - Staff 4 (S1 - S4), C1's Regional Center Service Coordinator, C1's Behaviorist, Client 1 (C1), and attempted to interview Client 2 - Client 4 (C2 - C4).

The investigation revealed the following: regarding allegation "staff member sexually abused resident", it is alleged that C1 was sexually assaulted by the Licensee at the facility where the client resides and was impregnated. Licensee and staff denied the allegation. They stated that C1 has a history of making this kind of allegation. C1's Behaviorist of 15 years stated that the client has made several past allegations of being sexually assaulted by several staff members and being impregnated. The Regional Center Service Coordinator stated that the client has a history of making repeated allegations of sexual abuse. During today's visit, C1 denied sexual abuse by the Licensee or any other staff. LPA reviewed C1's behavior notes and observed multiple accusations of sexual abuse dating back to 2017.

Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

An exit interview was conducted and a copy of this report was provided.
