C3 confirmed they were shaken, but all the other information was inconsistent and totally different from what was reported, like who was present during the incident, and the date and time of the incident provided were completely different. C4 and C5 both denied seeing any abuse, but both clients said they have “heard” about other clients being abused.
Staff 1 (S1) also denied clients being assaulted by other clients in the facility. According to S1, the staff member will insert themselves in between clients whenever the clients are acting tough or attempting to provoke another client. Staff 2 (S2) says there’s arguments between clients, but staff get in between the clients and if that doesn’t work the staff will contact the CAT Team.
Regarding the complaint allegation: Facility client is selling drugs to other clients in the facility.
During the investigation, 10 of 14 individuals were unable to corroborate or provide any supporting information on the complaint allegation listed above. Two staff members denied the allegation. Staff 2 (S2) denied the allegation and explained one of the clients who is accused of dealing drugs is not a drug dealer, just a 7-Eleven panhandler. S2 says, they never see this client because during the daytime the client is sleep or away from the facility while S2 is working.
The majority of the clients interviewed made contradictory statements when asked about the complaint. When asked if anyone is selling drugs in the facility, one client said they were not sure, but they can sense the drug use and the same client said they are putting drugs in the food. When another client was asked if they have witnessed any of the client selling drugs, the client said, I haven’t seen anything, but when they go to each other’s room and say, “I have something for you”, I know what that is.
Based on the information gathered during the investigation through interviews and document review, the Department is unable to ascertain if the allegations occurred as reported. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove or refute the alleged violations occurred; therefore, the allegations are deemed Unsubstantiated.
