32 | a second boiler was affected that was tied to some of the assisted living in building A. Executive Director immediately scheduled a plumber to do maintenance repairs and sent out a notice to all residents. On February 04, 2022, Executive Director sent out a notice to all assisted living resident for the heaters not working properly. A second notice was sent out to all residents independent and assisted living resident indicated the following: Dear residents, we are experiencing intermittent issues with our hot water in the building A. If you find that your water isn’t hot enough to shower, we are offering a private shower in the spa in the B building by appointment only. For details and to make an appointment please reach out to our wellness department. Upon scheduled maintenance it was discovered that the boilers, chillers, and cooling towers needed work and systems were working at 50% and apartments were online and not being affected with the help of the other components of the system that allow it to work. On February 15, 2022, Helix Mechanical, Inc. provided a proposal of repairs to be completed. Tour of the physical plant of the facility room temperature measured at 82.4 Fahrenheit degrees and on visit conducted on March 02, 2022, room temperature measured between 72.9 – 82.4 Fahrenheit degrees. Title 22 regulation 87303(b)(1) Maintenance and operation a comfortable temperature for residents shall be maintained at all times. The facility shall heat rooms that residents occupy to a minimum of 68 degree F, (20 degree C). Interview with 5 of 5 residents indicated that rooms were warm but not hot and that the facility provides alternatives for residents like blankets if needed. Residents indicated that the facility wasn’t entirely cool but that it isn’t scorching hot either. The facility has maintained the residents up to date with the repairs of the facility and with providing alternatives.
Based on the information mentioned above, the Department is unable to ascertain if the allegation occurred as reported. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove or refute the alleged violation occurred; therefore, this allegation is deemed Unsubstantiated.
An exit interview was conducted with Executive Director and a copy of this LIC9099 report was left at facility. |
