13 | Complainant alleges that the Provider is in violation of Health & Safety Code (H&SC) §1771.8(g) which states that “A provider shall, within 10 days after the annual report … provide, at a central and conspicuous location in the community and in a conspicuous location on the provider's Internet Web site, a copy of the annual report…”
The Continuing Care Contract Bureau (CCCB) reviewed its records and received an email communication from Provider on May 30, 2023, notifying the department that the annual report would be delayed with the anticipated date of June 30, 2023, as the completion date. On July 3, 2023, Provider emailed again stating that there will be a further delay in submitting the annual report. CCCB advised the provider that a late fee of $1,000 would be imposed pursuant to H&SC 1790(a)(6)(b). In addition, if the reports are submitted after July 31st, there will be an additional $33/day fine imposed until submission and this is on a community basis.
The Provider has not yet submitted their 2022 annual report as required by H&SC §1790(a), so there is no report at this time to provide at the community or on the Provider’s webpage. Therefore, the Department finds the allegation “unsubstantiated”. The Provider has been reminded of the requirements of H&SC §1771.8(g) once the 2022 annual report is submitted to CCCB.
