Licensing Program Analyst (LPA) Jenifer Tirre made an unannounced visit to deliver findings on the complaint investigation. LPA met with and discussed the purpose of the visit with Associate Executive Director Marlen Hernandez
The department investigated the above allegation and the investigation consisted of interviews, observations, and documentation. It was alleged that Staff do not ensure the residents have hot water while in care. Based on observations, LPA tested water temperature in 11 resident rooms on each 3 levels in both Assisted Living and Memory Care areas. Water tested in these rooms tested between 109.5 to 117.0 degrees Fahrenheit. Per Title 22 Regulations. Hot water temperature controls shall be maintained to automatically regulate the temperature of hot water used by residents to attain a temperature of not less than 105 degree Fahrenheit and not more than 120 degree Fahrenheit. During investigation, two rooms tested at 103.5 and 103.8. These rooms during visit Maintenance Coordinator corrected water temperatures and temperatures in these rooms were re-tested at 114.6 and 117.0 Fahrenheit.

LPA observed facility water temperature testing logs from November to December 2022. Logs indicated that facility conducts random water temperature testing 3x a week with water temperatures in compliance between 111.0 to 120.0 degrees Fahrenheit.

Interviews with residents revealed that 4 out of 4 residents all stated no complaints with water temperature in showers and all 4 residents stated they receive warm to hot water in rooms. Of residents interviewed 2 out of 4 residents claim water in sinks take a few minutes to warm up. Each resident room has a restroom with a shower and sink as well as a additional sink outside from restroom area. Interviews with staff revealed that facility has two water boilers one for each building. Interviews revealed that facility has a new mixing “Brain” water valve which gets checked once a month. During interviews staff indicated if water faucets have not been turned on or used in a while, water temperatures take a few minutes to warm up which staff state they have communicated to residents. Interviews also indicated that staff encourage residents to hand wash with warm water.

Based on conflicting information received in observations, interviews, and the lack of corroborating witness to the incident in question LPA is unable to determine if the alleged violation occurred as reported.

The department has found that the complaint allegation staff do not ensure the residents have hot water while in care is deemed UNSUBSTANTIATED, meaning although the allegation may have happened or is valid; there is not a preponderance of evidence to prove that the alleged violation occurred as reported.

This report is being reviewed with Associative Executive Director and a copy of this report was left at facility.
