This unannounced visit conducted by Licensing Program Analyst (LPA) Ruth Martinez is being conducted to initiate the 10-day visit to investigate the above mentioned complaint allegations. LPA arrived at the facility and was greeted and granted entry by staff. LPA spoke to Mark Cruz, Administrator, and explained the nature of the visit.

During the course of the investigation, findings are based upon interviews conducted, a tour of the physical plant of the facility conducted and copy of pertinent documents obtained.

It is alleged that the facility is in disrepair. Based on interviews with 2 of 2 staff indicated that on February 18, 2022, it was reported to landlord that there was a leak in the garage ceiling. The leak was fixed but

the esthetics of the ceiling were left as they were. Records review revealed that there was a leak at one point, but it was fixed. The tour of the garage shows the top left side of the door entry way of the garage to have been worked on, LPA inspected and did not observe to be any water marks or leaks coming from that location. LPA observed an AC unit in the exterior of the facility with the top screen with a wear and tear due to the weather conditions and the unit being outside. LPA tested the air flow and temperature of the facility. LPA observed that when the air conditioning was placed in cool mode the fans of the AC unit to be working with no issue. LPA tested the temperature of the cool air flowing from the vents and it measured at 78 Fahrenheit degrees, LPA changed the temperature to warm and waited 15 minutes to observe the change. LPA measures the hot air flow from the vent to be 82.2 Fahrenheit degrees which is within regulation compliance. Interviews with 2 of 2 residents indicated they have never had an issue with the facility not being cool or warm. Residents indicated that they have always had air flow by the vents and the facility is cool or warm as needed.
It is alleged that staff did not provide a safe and comfortable environment for residents. LPA observed a 3 camera installed in the dinning room, hallways of the facility and in the garage. Interviews with 2 of 2 staff revealed that cameras were at the facility prior to Licensee taking over the facility and staff never had access to the cameras. Staff indicated that they don’t work and the only person who has access to the cameras is the landlord. LPA obtained a copy of the lease agreement page 4 number 17 states without Landlord's prior written consent, (i) Tenant shall not make any repairs, alterations, or improvements in or about the Premises including: painting, wallpapering, adding or changing locks, installing antenna or satellite dish(es), placing signs, displays or exhibits, or using screws, fastening devices, large nails or adhesive materials. Records received revealed that the cameras have never worked. LPA tour of the physical plant of the facility there was no observation of a monitoring screen for the cameras that were observed and observed cameras to be dusty with dirt particles in the interior of the camera dome.

Based on the information mentioned above, the Department is unable to ascertain if the allegation occurred as reported. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove or refute the alleged violation occurred; therefore, this allegation is deemed Unsubstantiated.
An exit interview was conducted with facility representative and a copy of this LIC9099 report was left at facility.
