On July 6th, 2022, Licensing Program Analyst (LPA) Jeremey McClain met with Director Andreana Thornsberry for the purpose of a complaint investigation. At approximately 8 am, LPA observed six infants supervised by two staff in Infant Room A and four infants supervised by one staff in Infant room B. At approximately LPA observed eight infants supervised by two staff, and four infants supervised by one staff member the toddler room. LPA investigated the allegation that staff at the facility are not following proper reporting requirements providing false incident reports to parents and authorized representatives.

During the investigation LPA conducted interviews with staff. Although the allegation may be true, LPA determined that the evidence was not sufficient to corroborate it. The Preponderance of Evidence Standard has not been met; therefore, the allegation is determined to be unsubstantiated.

No Title 22 deficiencies were cited regarding this allegation. LPA reviewed this report with Director Andreana Thornsberry and provided a Notice of Site Visit that must be posted for 30 days.

On July 6th, 2022, Licensing Program Analyst (LPA) Jeremey McClain met with Director Andreana Thornsberry for the purpose of a complaint investigation. At approximately 8 am, LPA observed six infants supervised by two staff in Infant Room A and four infants supervised by one staff in Infant room B. At approximately LPA observed eight infants supervised by two staff, and four infants supervised by one staff member the toddler room. LPA investigated allegations that the facility was operating out of ratio, and that staff without qualifications were supervising infants in care.
During the investigation, LPA conducted interviews with staff, observed ratios and staff schedules. LPA also reviewed staff files. During today’s inspection, LPA observed Staff 1 and Staff 2 supervising supervising eight infants, and Staff 3 supervising four infants. During file review, it was determined that neither Staff 1, 2, or 3 have the required qualifications for Infant teachers. Furthermore, it was determined that Staff 4, who also does not have Infant teacher qualifications, has supervised infants alone in Infant Room B after the lead teacher completes her shift. Based on file review and interviews, it was determined the allegations were true. The Preponderance of Evidence standard has been met; therefore, the allegations are determined to be substantiated. Type A Deficiency
LPA Jeremey McClain informed licensee Director Andreana Thornsberry that this report dated July 6th, 2022 documents a Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care.

Also, LPA Jeremey McClain informed the Director Andreana Thornsberry to provide a copy of this licensing report dated July 6th, 2022 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Posting Requirements
Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

This report was reviewed with licensee, and an exit interview was conducted.

Appeal Rights, and a Notice of Site Visit was provided and should remain posted for 30 days.

Infant Care Teacher Qualifications and Duties. (b)Prior to employment, an infant care teacher shall have completed, with passing grades, at least three postsecondary semesters or equivalent quarter units in early childhood education or child development, and three postsecondary semester or equivalent quarter units related to the care of infants, at an accredited or approved college or university.(1)After employment, a teacher who has not completed the course work required in (c)(1) below shall complete, with passing grades, at least two units each semester or quarter until the education requirements are met.

Director will start hiring process to find qualified infant teachers. Director will submit a request to District Leader for approval to hire more qualified staff. "CDA with Class", offered by Teachstone Kinder Care Education will be reviewed to determine if completion of the course meets Title 22 qualification requirements. Director will send LPA

This requirement was not met as evidenced by file review. LPA observed that Staff 1, 2, 3 and 4 did not any of the required qualifications, but were supervising infants wihtout the prescence of a fully qualified teacher. This is a potential risk to health and safety of children in care.
