Licensing Program Analyst (LPA) Jeremey McClain met with facility representative Monica Arredondo to deliver findings for a complaint investigation. LPA observed 19 infants supervised by six staff.

The following was alleged:
1) Staff did not honor the personal rights of children by hitting them, speaking to them inappropriately, handling them roughly, and using and threatening corporal punishment.
2) Staff do not report incidents involving day care children as required.
3) Unqualified staff are providing care to day care children without supervision.

During the investigation, LPA interviewed current and former staff, made observations in classrooms, and reviewed staff and children’s files. Based on the evidence gathered, the preponderance of evidence standard has been met; therefore, the allegations are SUBSTANTIATED.

Regarding allegation 1, interviews and file review revealed that former staff did not honor the personal rights of children in care. It was stated that staff witnessed Staff 1 and Staff 2 mistreat children by grabbing them roughly by their arm, pulling them by their clothes, using swear words at and around them, and using corporal punishment such as spraying them with water and threatening to wash their mouths with soap.

Regarding allegation 2, staff and parent interviews were consistent that there were incidents with child 1 and child 2, that required medical attention. These incidents occurred in May 2024. LPA did not receive Unusual Incident Reports regarding these incidents, nor were they reported to the CCLD Sacramento Regional Office within 24 hours.

Regarding Allegation 3, LPA observation, file review and staff interviews corroborated that unqualified staff are providing care to children. On 06/10/2024, LPA observed staff 3 providing care to four infants in the toddler room. File review and staff interviews confirmed that that staff does not have the required qualifications to supervise children alone. Interviews also corroborated that other staff without the required qualifications supervise infants alone.

An exit interview was conducted, and LPA reviewed this report with facility representative Monica Arredondo. LPA provided appeal rights and a Notice of Site Visit that shall remain posted for 30 days.

Deficiencies are noted on the 9099-D pages, and if not corrected, pose an immediate and potential risk to the health and safety of children in care.
Type A citation
LPA McClain informed facility representative Monica Arredondo that this report dated July 3rd, 2024, documents one Type A citation, which shall be posted for 30 consecutive days as there were immediate risks to the health, safety, or personal rights of children in care.
Also, LPA McClain informed facility representative Monica Arredondo to provide a copy of this licensing report dated July 3rd, 2024, that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
Posting Requirements
Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
