Licensing Program Analyst (LPA) Jeremey McClain met with facility representative Esther Gamache to deliver findings for a complaint investigation. LPA observed 31 children supervised by 3 staff.

The following was alleged against the facility: 1. Facility did not provide a safe environment resulting in day care child being injured, 2. Licensee did not ensure that the facility was kept in good repair.

During the investigation LPA interviewed staff, reviewed staff files, and observed windows in the “2’s” classroom.

Based on the evidence gathered, the preponderance of evidence standard has been met. All allegations have been SUBSTANTIATED.

Interviews and file review corroborated that the windows in the 2’s classroom have needed repair for at least three years, which was known by staff at the facility, but not made known to leadership. Facility representative submitted an Unusual Incident Report on 1/16/2026, reporting that a window closed on a child’s finger, which required immediate medical attention. The full extent of the injury has not been determined. Interviews corroborated that staff attempted to open the broken window, before it slipped and closed on a child's finger.

LPA Jeremey McClain informed facility representative Esther Gamache that this report dated 1/29/2026 documents a Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk to the health, safety, or personal rights of children in care.
Also, LPA Jeremey McClain informed facility representative Esther Gamache to provide a copy of this licensing report dated 1/29/2026 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

An exit interview was conducted, and this report was reviewed with licensing representative Esther Gamache. Appeal rights were provided. A Notice of Site Visit was provided and shall remain posted for 30 days.

A work order to repair the windows was submitted on 1/21/2026. Maintenance and a window vendor observed repairs needed at the facility on 1/28/2026, and new windows were ordered. All staff were told not to open windows, and windows were locked. Staff were required to complete a training on

evidenced by staff interviews and an Unusual Incident/Injury that was reported on 1/16/2026. On 1/15/2026, a window closed on the finger of Child 1, after Staff 1 opened the window, although there were signs on the window not to open it. Some staff were aware the the window needed repair for approximately 3 years, however a repair was not ordered until after the incident.

Licensing Program Analyst (LPA) Jeremey McClain met with licensing representative Esther Gamache to deliver findings for a complaint investigation. LPA observed 31 children supervised by 3 staff.

It was alleged that unqualified staff are providing care and supervision at the facility.

During the investigation we reviewed staff qualifications and conducted interviews. LPA was unable to gather documentation to support when this violation occurred, if it did occur.

Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation occurred.

An exit interview was conducted, and this report was reviewed with licensing representative Esther Gamache. Appeal rights were provided. A Notice of Site Visit was provided and shall remain posted for 30 days.
