Licensing Program Analyst (LPA) Michelle Perez, met with Director Michelle Zemlicka on September 6, 2023 for the purpose of opening a complaint investigation. LPA observed 27 children in care, supervised by five teachers.
It was alleged that staff do not ensure adequate supervision which resulted in child #1 being bitten by child #2. LPA investigated this allegation, through interviews with teachers, children, Director as well as the guardian of child #1. LPA found that child #1 did not sustain a bite injury, as teachers were around child #1 while in the classroom and in the play yard. LPA did find that child #1 stated they were bitten, but could not provide factual information. Child #1, explained a situation that did not occur and this was confirmed by the Director, teachers and the guardian. Teachers stated that child #1 is very vocal and expressive and if injured or upset will always let them know. Moreover, LPA spoke to child #2, who explained that they did not bite child #1 and teachers confirmed that child #2 does not attend the same classroom as child #1 nor do they play together in the play yard.

LPA also found that when speaking to guardian of child # 1, they explained that child #1 will always vocalize anything that has happned at the facility, and is very expressive. Guardian also explained that no marks were ever found on child #1 when picked up from the facility.

Further, guardian also explained that the allegation of the injury, most likely came from a secondary guardian who does not see child #1 during the time frame of when it could have occurred due to legal issues.

The allegation of staff did not ensure reporting requirements were followed, was investigated by LPA. LPA found that there was no incident to report, as child #1 did not incur a bite from child #2.

When investigating the allegation of staff do not ensure sign in / sign out procedures are followed for children in care, LPA learned that all sign in and out procedures are completed online with an app, called "Procare." The guardians are able to sign their child in or out on the app, and if the guardians do forget to sign their child in/out, the app will alert staff and the parent will be notified. LPA observed this on the app and can verify procedures are being followed.

Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore all allegations are unsubstantiated.
