On 2/10/2025, Licensing Program Analyst (LPA), Michelle Perez, conducted a visit to close a complaint investigation. Upon arrival there were 18 children in care and 03 teachers suprervising, in addition to the director.
LPA investigated the allegation “facility are keeping children outside in the cold for a period of time.” LPA interviewed the director/owner, teachers, Reporting Party and children at the facility to see if any violations occurred. LPA also made observations of children in care, while they played outside in the morning hours. LPA found that there is a scheduled posted in the classroom, which has outside time between 8AM and 9AM. During this time frame, children are dropped off, and will eat breakfast outside and have some play time, before going inside to begin their classroom day. LPA found through speaking with teachers, that most children do come with jackets, gloves, and hats, and they are put on when they are outside. The teachers explained that there are some children whose parents will not bring jackets for them, and those parents are reminded on a consistent basis to dress their children appropriately. LPA also found that teachers have the autonomy to utilize as much time outside as they would like, during that hour that is given to them.

If a teacher wishes to utilize only a portion of that time, they are allowed to do so, or they can adjust their outside time, due to weather. LPA spoke to parents, who explained that although it can be cold in the mornings, their children have never complained, and they do have jackets when they are sent to school. Parents explained that the children are not cold and will run around which keeps them warm. When LPA spoke to the children, they explained that they have jackets, hats, and gloves on, when they go outside. LPA observed many children with these items on, while outside playing. The children explained to LPA that they would also use their pockets if their hands were cold.

Based on the information obtained, LPA could not corroborate the allegations.
Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

A notice of site visit was provided and will be posted for 30 days.
