Licensing Program Analyst (LPA) Jeremey McClain met with Director Jenny Aguilar for the purpose of delivering findings for a complaint investigation. Upon arrival, LPA observed 25 preschool children supervised by six staff in four separate rooms. LPA investigated allegations following allegations: 1) Staff did not ensure hazardous materials were inaccessible to day care children;2) Staff smokes on facility premises.

During the investigation, LPA conducted interviews with current and former staff, reviewed staff files, and reviewed an incident report regarding an incident that occurred on 12/15/22.

On 12/15/22, Child #1 was found with a vape pen in her mouth by Staff #1 and Staff #2. The vape pen (smoking device) was left on the playground after it was lost from Staff #3. The vape pen was not observed or retrieved before the children used the playground and was found by Child #1. The evidence was not sufficient to determine that Child #1 ingested from the vape pen, however evidence was conclusive that Child #1 had the vape pen in their mouth, and later suffered from an upset stomach and diarrhea for up to 24 hours after the incident. Evidence was conclusive that Staff #3 was previously observed by other staff members smoking the vape pen in the staff break room at the facility. Administration was not aware of Staff #3 smoking in the break room until after the incident occurred on 12/15/22.

Based on the evidence that was gathered, LPA determined the preponderance of evidence standard has been met, therefore, the allegations are determined to be substantiated.

Type A Deficiency
LPA Jeremey McClain informed facility representative Jenny Aguilar that this report dated January 11th, 2023, documents 1 Type A citation which shall be posted for 30 consecutive days as there was immediate risk to the health, safety, or personal rights of children in care.
Also, LPA Jeremey McClain informed the licensee Jenny Aguilar to provide a copy of this licensing report dated January 11th, 2023, that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Posting Requirements
Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Appeal Rights were provided, and an exit interview was conducted. A Notice of Site Visit was posted and must remain posted for 30 days.

Staff #3 is no longer employed at the facility. Director stated that she will review with staff procedures for safety checks of the playground before usage by children. Director will reiterate to staff that smoking is not allowed on or near the premises.
