An unannounced inspection was conducted today by Licensing Program Analyst Owens and McClain. LPA's met with Director, Jessica Peoples. and Buneet Nathani, Partmer. The purpose of the inspection was to open and close a complaint investigation. Present at time of inspection were 21 preschool children with 2 staff and 9 infants with 2 staff. Interviews were conducted and LPA obtained documents relevant to the investigation.

Based on interviews and documentation a child in the infant program has bitten multiple children, multiple times, leaving marks/bruises. Staff have been present during the biting, however the staff was unable to intervene to prevent the bite and the child has continued to bit other children. A preventative plan has not been put in place to prevent the child from biting. The preponderance of evidence standard has been met during this investigation, therefore the above allegation is found to be SUBSTANTIATED. Violations of the California Code of Regulations, Title 22, Division 12 & Chapter 3 are being cited on the attached LIC9099D.

This is a Type A deficiency, hence AB633 Notification Applies: Upon receipt of this report, the report must be posted along with the notice of site visit for 30 days for parents to view. Licensee must inform the parents/guardians of children in care at the facility and to the parents/guardians of children newly enrolled at the facility during the next 12 months via form LIC 9224 Acknowledgement of Receipt of Licensing Reports.

The licensee shall ensure that each child is accorded the following personal rights:
To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning.

The Director stated they will staff to have child shadowed one on one. If child continues to bite then possible termination will take place. .

This requirement was not met by:
