On 7/19/2023 LPA Tryon visited the facility to complete the complaint. LPA met with staff Priscilla McIntyre. There were 2 staff on duty during the visit today. LPA also spoke by phone with licensee/Administrator Tatiana Magurean.
Regarding the allegation that the facility is denying residents personal rights, this was in reference to an allegation that resident R1 was being denied visitors. LPA has spoken with witnesses, staff, residents, reviewed documentation. It appears that there was some early discussion about responsible party not wanting resident to have visitors for whatever reason. However, it appears that the facility staff were very knowledgeable that resident had the right to have visitors if he wanted, and visitation was never denied to anyone. Allegation is UNFOUNDED.
Regarding the allegation that facility is overmedicating resident, LPA has spoken with witnesses, staff, residents, reviewed documentation. LPA finds no evidence that resident R1 was being overmedicated in any way. Allegation is UNFOUNDED.
Regarding the allegation that the facility refused to turn on AC during hot weather, LPA has spoken with witnesses, staff, residents, and visited the facility on 3 occasions since opening the complaint. Each time

LPA visited the air conditioning was running and the house was comfortable. Visits were on relatively hot days and the temperature was at an acceptable level and LPA could hear the system running. Residents were asked and said they were comfortable. It should be noted that as individuals age they seem to frequently feel more comfortable with less a/c; they seem to more often report being "colder" than younger people. Although visitors or staff may think the house is too warm, the residents may be very comfortable for residents. Staff report that residents complain of being cold if the air is turned on too cool. In addition to this, the house was at a temperature that is within acceptable range as per Title 22 Regulations. As per Title 22, Section 87303(b)(2) Maintenance and Operation: The facility shall cool rooms to a comfortable range, between 78 degrees F (26 degrees C) and 85 degrees F (30 degrees C), or in areas of extreme heat to 30 degrees F less than the outside temperature. During visits LPA found the temperature to be at 80 degrees F, within the above range. Therefore the allegation is UNFOUNDED.

A finding of UNFOUNDED means that the allegation is False, could not have happened and/or is without a reasonable basis.
