On 10/20/2022 LPA Tryon visited the facility to complete the complaint. LPA met with Executive Director John O'Brien.
LPA has inteviewed the Administrator, staff, reviewed documentation, reviewed evidence.
Regarding the allegation that the resident did not receive prescribed medications, in reviewing the complaint, it was stated that former resident R1 had not taken medications for 3 days prior to contact with the complainant in August 2022. However, in speaking with staff and reviewing documentation, R1 actually moved out of Oakwood Village in MARCH 12, 2021. Therefore, by the time of the complaint, R1 had not resided or been present at Oakwood Village for approximately 17 months at that time. Therefore, if she did not receive her medications for several days prior to August 17, 2022, she was not living at Oakwood, and there is no way the allegation is relative to the facility. Therefore, the allegation is UNFOUNDED.
Regarding the allegation of possible financial abuse, again, R1 had not lived at Oakwood Village for 17 months. It was stated that her purse was stolen. LPA could find no evidence of this being true. LPA also learned from interviews that R1 often said that her purse was missing or stolen when living at Oakwood;

and there was no evidence that the purse had ever been stolen. Also, the complaint alleged that she gave her car to a staff at Oakwood. LPA learned through interviews and documentation that R1 did in fact own a car while a resident of Oakwood. Before moving, R1 had been giving away belongings, as there was no place to put them/store them, and no one to leave them to. R1 apparently offered to give her car to a staff person at Oakwood, in order to get rid of it. She did SELL the car to a staff person at Oakwood for $1.00; but this was done about 2 weeks AFTER moving out to another placement. Therefore, the staff who bought the car was no longer working as a staff person with R1. There is a receipt signed by R1 for the purchase of the car. In exploring the matter, LPA learned that the car does not run, and is actually STILL AT OAKWOOD VILLAGE in the parking lot. The person who "bought" the car has not been able to move it and it has stayed in the back parking lot of the facility. In addition, R1 did not have the title document available, so the staff does not officially have title to the car. It is still just sitting in the lot. Also, LPA found no evidence that any staff in any way had access to the funds or accounts of R1. Therefore, LPA finds the allegation to be UNFOUNDED.
A finding of unfounded means that the allegation is false, could not have happened and/or is without a reasonable basis.
