32 | It was alleged that there was construction at the facility where asbestos was being removed and cautionary signs placed on doors but that neither staff nor teachers were notified beforehand. Interviews revealed a couple of staff were notified of construction while most staff were not. Documentation confirms an email went out to staff, but LPA could not confirm that all teachers and staff were included in the email. It was disclosed that authorized representatives were expressing concerns to facility staff about the safety of their children while construction went on. During an inspection visit, LPA observed doorways being obstructed to prevent debris, however, was unable to confirm if the construction area was made inaccessible prior to construction taking place. In addition, although the facility submitted an unusual incident report (UIR) in a timely manner, there is no record of the facility placing a call to the department to notify them of construction taking place.
Based on interviews with all pertinent parties and documentation received, conflicting information was obtained from what was alleged. Although the allegation may have happened, or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.
An exit interview was conducted, and a copy of this report was provided to the Site Director, Evelin Valenzuela
A Notice of Site Visit was also provided and posted which must stay posted for 30 days.
