On 11/05/2024 at 12:45 PM, Licensing Program Analyst (LPA) Melody Brown met with Executive Director (ED) Griselda Garcia at Community Care Licensing Division (CCLD) Adult and Senior Care (ASC) Regional Office to deliver the findings of the above allegations. LPA Brown explained the purpose of the requested Office Visit. The investigation consisted of observation, interviews, and a review of pertinent documentation.

The investigation was conducted by LPA Melody Brown. The investigation consisted of observation and interviews with relevant parties. The first allegation indicates that staff left resident in soiled diapers. During the investigation, LPA Brown did not find evidence to corroborate the allegation. Interviews with seven (7) of seven (7) residents indicated that staffs are checking on them two (2) or three (3) times a day if they need to change their diaper or if they need assistance. Seven (7) of seven residents interviewed reported that there's no incident happened that they know of that a staff left a resident ***Continuation in LIC9099C***

in soiled diapers. Interview with Resident #1 (R1) indicated that staff at the facility are checking on R1 multiple times a day and they were asking if R1 need a change of pull-ups or R1 needs assistance. R1 reported to LPA Brown that staffs at the facility are kind, helpful and sweet and they treat R1 like family and R1 added that there's no incident that happened that a staff left R1 in soiled pull-ups/diapers. Interviews with six (6) of six (6) staff indicated that they are checking on all their residents every two (2) hours and every one (1) hour on residents that need more care. Six (6) of six (6) staff interviewed reported that there's no incident that they left R1 in soiled diapers and there's no incident happened at the facility that a staff left a resident in soiled diapers because all of them are checking on their residents every two (2) hours or more frequently if needed. During the facility visits on 03/12/2024, 04/02/2024, 04/09/2024 and 05/02/2024, LPA Brown observed staffs at the facility doing their rounds and checking on their residents multiple times to inquire if they need assistance or they need a diaper change.

The second allegation indicates that staff restricted resident's access to room and unable to use restroom. Interviews with seven (7) of seven (7) residents indicated that staffs at the facility are not restricting them access to their room that they are unable to use the restroom. Interview with R1 indicated that staffs at the facility are not restricting R1 access to R1's room that R1's unable to use the restroom. R1 reported to LPA Brown that staffs at the facility are always assisting R1 to go to R1's room so R1 can use the restroom. R1 added that there's no incident that happened that a staff restricted R1 access to R1 room and R1's unable to use the restroom. Interviews with six (6) of six (6) staff indicated that they are not restricting their residents access to their room that their residents cannot use the restroom. Six (6) of six (6) staff interviewed reported that there's no incident that happened that they restricted R1 access to R1's room that R1's unable to use the restroom. Six (6) of six (6) staff interviewed added that they are all assisting their residents to go to their room and use the restroom except for the residents that have a key to their room and there's no incident that happened that a staff restricted a resident access to their room that they're unable to use the restroom. During the facility visits on 03/12/2024, 04/02/2024, 04/09/2024 and 05/02/2024, LPA Brown observed staffs at the facility assisting residents to go to their room. In addition, LPA Brown also observed residents that have a key to their room. Moreover, LPA Brown did not observe a resident restricted access to their room by a staff and unable to use the restroom.

Based on the evidence, the allegation that Staff left resident in soiled diapers (Allegation #1), and staff restricted resident's access to room and unable to use restroom (Allegation #2) are UNSUBSTANTIATED. A finding that the complaint is UNSUBSTANTIATED means ***Continuation in LIC9099C***
