This unannounced visit by Amy Goldenberg, Licensing Program Analyst (LPA), is being conducted to conclude this agency’s investigation into the complaint allegation mentioned above.This unannounced visit by Amy Goldenberg, Licensing Program Analyst (LPA), is being conducted to conclude this agency’s investigation into the complaint allegation mentioned above. Investigation included a medication audit, two (2) staff interviews and eight (8) resident interviews. Investigation revealed the following information: Medication audit conducted by LPA Torrez on 07/13/2021 revealed seven (7) medications which have orders but are not available at the facility to dispense. Seven (7) of eight (8) residents interviewed inform LPA that they are currently receiving their medications as ordered, but have had concerns in the past. Eight (8) of eight (8) residnets interviewed indicate that they have never been denied a meal by staff. Two out of two (2) kitchen staff interviewed report that when residents require it meal substitutes or alternatives are provided and deny failing to provide any resident with a meal. In regard to the allegation of fcility staff not administering medications per physician order, we have substantiated the complaint allegation as valid and that a violation has occurred based on the preponderance of available evidence. The licensee shall assist residents with self-administered medications as needed. The facility has not met this requirement as evidenced by medication audit revealing missing medications that have physician orders. This poses a risk to the health and safety of residnets in care.

Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred.
