On September 03, 2025, Licensing Program Analyst (LPA), Venus Mixson arrived at the facility unannounced and met with the Administrator, Charmaine Sims. LPA explained the reason for the visit was to provide findings for the complaint investigation. During the investigation, LPA conducted interviews, record reviews, and made observations regarding the listed allegations.
On February 06, 2025, Community Care Licensing received a complaint alleging staff speak to resident in an inappropriate manner, staff does not follow the facility menu, and the right to move from the facility in accordance with the terms of the Admission Agreement.
Regarding the allegation staff speak to resident in an inappropriate manner, it was reported the facility staff are rude to Resident # 1 (R1). Information obtained from an interview with Administrator, Charmaine Sims, it was stated R1 never advised the facility staff was speaking to Resident in an inappropriate manner. Interviews with additional staff members denied speaking to R1 or any of the residents in an inappropriate manner. Information obtained from R1 denied the facility staff speak inappropriate to them and there are no concerns.

Additional information obtained from interviews with residents advised there are no challenges with how they are treated and their needs are being met. LPA’s review of the records, including staff files, revealed there were no indications of disciplinary actions pertaining to personal rights violations or reports from residents of staff speaking inappropriately to them. LPA observed the facility staff interact with the residents and there were no concerns.
Regarding the allegation staff does not follow the facility menu, it was reported the facility staff occasionally prepares resident’s meals and the meals are not according to what is listed on the menu. Information obtained from Administrator advised facility staff prepare meals in accordance to what is listed on the menu. Administrator provided LPA the weekly menus and monthly grocery shopping receipts to corroborate the information. Additionally, Administrator stated none of the residents have advised them there are issues or concerns regarding food service. According to information obtained from interviews with the additional facility staff, there were no stated challenges with the meals being prepared matching the items listed on the menu. Interviews with R1 indicated there was not a time when the facility staff did not prepare what was on the menu and there are no concerns regarding food services. Additional interviews with further residents revealed there are no concerns with regards to the food prepared by the facility staff. A review of the records confirmed grocery shopping items on the monthly receipts coincide with the meals on the weekly menu. While conducting an unannounced visit at the facility, LPA observed the meal served was listed on the posted menu.
Regarding the allegation of the right to move from the facility in accordance with the terms of the Admission Agreement, it was reported R1 wanted to move, but the Facility Manager bribed R1 with money to remain at the facility. According to interview with Administrator, the allegation is false. Administrator advised a previous staff member had been contacting residents to request the residents to move to another facility, overseen by the same Licensee. Administrator indicated they have never offered R1 or any of the residents in care, any money or any kind of favors for any reason. Administrator stated there was no advisements of R1's desire to move. Information obtained from interviews with facility staff corroborated they were unaware R1 desired to move and a monetary incentive was given to retain them. Information obtained from interview with R1 stated the Administrator has never offered them money for any reason.
Based on information obtained from interviews, record reviews, and observations, and the inability to interview pertinent parties, the evidence received did not support the allegations. The allegations staff speak to resident in an inappropriate manner, staff does not follow the facility menu, and the right to move from the facility in accordance with the terms of the Admission Agreement, has been considered unsubstantiated. An allegation finding of unsubstantiated means "although the allegation may have happened or is valid there is not a preponderance of the evidence strand to prove the alleged violation did or did not occur.
An exit interview was conducted. A copy of this report was discussed and given to the Administrator, Charmaine Sims.
