During a previous visit, LPA observed a wooden bench in a restroom in a toddler classroom for children ages 18 to 30 months. LPA did not observe a changing table or changing pad in the classroom. Interviews conducted disclosed consistent statements indicating the wooden bench is used to change older toddlers standing up. It was also disclosed that changing pads are not utilized as an alternative to changing tables. Records reviewed indicated a child who was under the age of two was present during the visit. Information obtained revealed the wooden bench was used to change the child standing up during the visit.
Based on observations made at the facility, information obtained during interviews, and records reviewed, the preponderance of evidence standard has been met; therefore, the above allegation is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12, Chapter 1), are being cited on the attached LIC 9099-D.
LPA conducted a file review prior to conducting the visit and observed a deficiency was issued on 04/25/2024 for not utilizing changing tables for toddlers ages 18 to 24 months. LPA reminded Site Supervisor that each infant must be diapered on a changing table or on a changing pad placed on the floor that meets the requirements of Title 22 section 101439(h). Infants are children under the age of two.
LPA Tiffanie Diep informed the site supervisor, Kimberly Pixley, that this report dated 08/15/2024 documents one Type B citation as there was a potential risk to the personal rights of children in care.
Also, LPA Tiffanie Diep informed Site Supervisor that this is defined as a repeat violation since this is the second time within a 12-month period for the same violation. Therefore, a deficiency and civil penalty are being cited on the attached LIC 9099-D. This repeat violation results in an immediate civil penalty of $250. A civil penalty of $100 per day will continue to be assessed until the violation is corrected.
An exit interview was conducted and report was reviewed with the site supervisor, Kimberly Pixley. A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
