On November 22 2022 at 1:51 PM, Licensing Program Analyst (LPA) Anastasia Flores met with Assistant Director, Farhana Alem in regard to the above allegations. On September 15,2022 at 8:17AM, LPA conducted health and safety inspection of the facility and no immediate concerns were observed. Copies of facilities children’s roster, staff roster, agreement policy and confidential incident reports were obtained. Interviews were conducted with five out of five staff during investigation.
On September 12, 2022 this office received allegation that day care child sustained unexplained injuries while in care. Confidential interviews disclosed that child #1 (C1) was picked up from the facility with scratches on C1’s face. Other confidential interviews revealed that staff denied the injury to C1 happened at the facility. Interview with Assistant Director (S1) disclosed that staff wrote an incident report, stating the child did not have any marks on the face on departure. Confidential records revealed staff #6, #7 did not see any marks on C1’s face at the time of departure from facility. Interview with S1 disclosed that she had to investigate the incident on 9/09/22 due to the regular teachers were gone for the day. Other confidential record review dated 9/12/22 revealed the incident report was re-written.

An additional allegation was received that staff are not meeting day care child’s toileting needs while in care. Confidential interviews disclosed that C1 had been sent home with a wet diaper one week in a row. Interview with S3 revealed the children are taken, to the bathroom at least once an hour and if the child is wet the diaper or pull up is changed. LPA Flores observed changing log.
An additional allegation was received that staff did not prevent day care child from drinking out of a moldy cup while in care and that allegation was received that staff are not properly cleaning cup used by day care child while in care. Confidential interviews disclosed that on 9/10/22, C1 was sent home with a sippy cup and the cup straw had mold on it. Interview with four out of four staff disclosed the children are supposed to take their sippy cups home daily and that some children will bring a new water bottle every day and that some will bring a sippy cup with water. Interview with S1 disclosed the parents will sometimes forget to take the cups home and the staff will rinse them with soap and water.

Due to a lack of cooperation from complainant, LPA was unable to corroborate allegation and/or gather supporting evidence. Therefore, the allegations are unsubstantiated.  Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED.

An exit interview was conducted and copy of this report, appeal rights and Notice of Site Visit were provided to licensee. Licensee was reminded that the Notice of Site Visit must be posted in the facility in a visible area for 30 days.
