On 08/27/2025 at 9:00 AM, Licensing Program Analyst (LPA) Tiffanie Diep met with Director Brandie Rubalcaba for the purpose of a complaint inspection regarding the above allegation, and Director guided LPA on a tour of the facility. LPA observed five staff supervising 52 children. At 2:00 PM, LPA left the facility for a break. At 2:30 PM, LPA returned to the facility.

It was alleged that staff did not maintain a comfortable temperature for children in care. Throughout the course of the investigation, LPA made observations at the facility, obtained relevant documents, and conducted interviews with the staff and day care children.

Interviews conducted and records reviewed revealed an air conditioner (AC) for a classroom became inoperable on or about 08/12/2025 and repaired on or about 08/22/2025. Information obtained indicated there are a total of four AC units throughout the building and each thermostat controls the temperature for two areas inside the facility, which staff are able to view and manage. During today’s visit, LPA observed all four thermostats indicated the classrooms were between 70 and 72 degrees Fahrenheit (F). Interviews conducted disclosed the facility continued to use the affected classroom while its AC was inoperable. It was also disclosed staff continued to monitor the temperature throughout the facility via the thermostat reading. Consistent statements disclosed that classrooms were maintained between 70 and 74 degrees F; however, inconsistent statements were received regarding the alternative method used to maintain the temperature for the affected classroom. There were no disclosures made regarding anyone feeling uncomfortable with the temperature in the facility. Due to conflicting statements, it is determined there was not sufficient information evident to support the allegation that staff did not maintain a comfortable temperature for children in care.

Based on observations made at the facility, information obtained during interviews, and records reviewed, it is determined that the allegation could not be substantiated or dismissed. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur; therefore, the allegation is UNSUBSTANTIATED.

An exit interview was conducted and report was reviewed with the director, Brandie Rubalcaba. A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
