On 1/25/2022 at 3:00PM Licensing Program Analyst (LPA) Giselle Carbullido conducted an unannounced visit regarding a complaint received concerning the above allegations. LPA met with Ms. Rubalcaba to further discuss the complaint allegation(s) and deliver findings.
It was reported: Staff yelled at day care children.
Children interviews report staff yell when talking and yell to sit down. Staff interviews reported staff yell across the room, and yell to talk above the volume of children. Staff interviews revealed yelling has become the normal way to communicate and can sometimes have a firm tone when speaking to children.
This agency has investigated the complaint regarding the allegation. Based on interviews conducted the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED per California Code of Regulations 101223(a) (1), Title 22, Division 12.

An exit interview was conducted, and appeal rights discussed. LPA Carbullido provided facility representative with a copy of this report, notice of site visit and appeal rights.

On 01/25/2022 at 3:00PM Licensing Program Analyst (LPA) Giselle Carbullido conducted an unannounced visit regarding a complaint received concerning the above allegations. LPA met with Ms. Rubalcaba to further discuss the complaint allegation(s) and deliver findings.
During the investigation, LPA Carbullido reviewed facility documentation, and conducted interviews with pertinent individuals to this complaint.

It was alleged Staff handled day care child in a rough manner.

It was reported a teacher pulled on shoe laces too hard when tying laces. Children interviews reported no one pushes/pulls or handles them in a rough manner. Staff interviews denied witnessing any one handling children in a rough manner, nothing physical. However, a staff interview reported once a child’s chair was pushed with some force to scoot a child up to a table and are sometimes are pulled to go somewhere. When asked for further information, Staff did not provide additional details of whom, date or time.

It was alleged Day care children at this facility are not free from humiliation, intimidation, ridicule, coercion, threat or mental abuse. Children interviews did not report feeling threatened or scared by staff. Staff interviews denied witnessing anyone humiliating, intimidating or coercing children in care. Staff interviews also revealed children are also redirected from teasing others and are taught social skills.

Regarding food service, It was alleged Staff served expired food
It was alleged rotten food is being served at the facility. Children interviewed identified mac & cheese and pizza as favorite items; all children interviewed denied being served spoiled or rotting food. Staff interviewed report leftovers are thrown out at end of meals and Staff assigned to food preparation are required to write the date food items are received at the facility per food program. During tour of the kitchen area LPA observed over ripe bananas in a box, per kitchen staff prepped for disposal and boxes of expired crackers located on a top shelf that were unopened. LPA was unable to determine if the crackers or bananas were served to children in care.
There was conflicting information received during the investigation from what was reported and from LPA’s interviews with staff and children. This agency has investigated the complaint alleging staff handled children in a rough manner, facility is not free from humiliation, intimidation, ridicule coercion, threat or mental abuse, and facility served expired food. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegations are Unsubstantiated.
