Licensing Program Analyst, (LPA) Sean Williams arrived at the facility to conduct a complaint investigation. A census was taken and the facility was toured. It was alleged that a child’s personal rights were violated by allowing a child to nap on the floor without a proper cot to sleep on.

During the course of the investigation, LPA Williams conducted interviews with all other relevant individuals pertinent to this investigation and observed staff/ children interactions. On 11/14/19 LPA Williams also, observed a preschool child napping on the floor in the Directors office. A staff member informed LPA Williams that the child napping was their child, and the child was not feeling well so they allowed the child to sleep by their desk on the floor.
LPA explained to the staff member that the facility was in violation of Title 22 regulations (Activities 101230 (b)(1), and all napping children should be on the proper napping cot. (SEE 9099D). LPA Williams also explained to the staff member that even though it was their child, the child's personal rights have still been violated due to the child being cared for in a licensed facility. The staff member stated that they understood, and place the child on a napping cot. Please note: Mariah Gomez- Assistant Director had to sign this document due to Director Blanca Flores having to leave the facility. (CONTINUED ON NEXT PAGE)

The staff member stated that they would not have allowed any other children in the facility's care to nap on the floor without a cot, and thought since they were the child's parent, it was okay for them to allow the child to nap on the floor without a cot. The Director acknowledged that she now understands that it is a violation to allow children to nap on the floor without a cot, and moving forward, no children will be allowed to sleep on the floor without a cot.

Based on the observations and information gather for this investigation, the facility staff did allow a child to nap on the floor without a proper sleeping cot which is a violation of Title 22 regulations. Therefore, the preponderance of evidence standard has been met in this case, and the allegation on the first page of this report is deemed SUBSTANTIATED at this time on this date.



An exit interview was conducted with Director Blanca Flores, A Notice of Site Visit was provided, appeal rights discussed and given to Licensee, along with a copy of this report.

THIS REPORT MUST BE AVAILABLE TO THE PUBLIC FOR THREE YEARS.

PLEASE NOTE: LPA Williams had to leave the facility at 12:00PM and return at 5:00PM to conduct an interview with an individual who was not present in the morning hours.
