On the date and time listed above, Licensing Program Analyst (LPA) Giselle Carbullido arrived at the facility to conduct an investigation regarding the above complaint received on 08/25/2022. LPA was given access to the facility by the Desiree Padilla, Site Director. LPA discussed purpose of visit, took census and toured the facility. LPA met with the Director further discuss the complaint allegations and deliver findings.
During the investigation, LPA toured the facility, interviewed facility staff and children.
Staff pulled on a daycare child’s arm. It was alleged staff pulled a child’s arm while in a play area.
LPA toured the facility on unannounced prior visits 8/16/22; 8/18/22; 8/30/22 and 9/06/22 and did not observe teachers pulling on any child’s arm.
LPA interviewed 5 children and 3 staff. All children interviewed denied teachers pull on children’s arms. All staff interviewed stated they have not participated in or observed others pulling a child’s arm.
Staff spoke inappropriately to a daycare child. It was alleged staff cursed at a child.
LPA interviewed 5 children and 3 staff. All children interviewed stated teachers don’t yell or say bad words but kids do. All children denied observing or hearing a teacher use profanity at a child. All staff interviewed

denied using or observing others using profanity at a child. Staff interviews reported if a child uses profanity they are verbally redirected.

Facility does not allow parents to enter the facility. It was alleged facility does not allow parents to enter indoors.

LPA toured the facility on prior visits 8/16/22; 8/18/22; 8/30/22 and 9/06/2022; and observed parents entering into the portable to pick up children or calling or texting to have child sent out the front entry for pick up.

LPA interviewed 3 staff. Staff interviews reported Facility did limit parents to the front door entry during COVID pandemic per CDPH Childcare guidance. Staff interviews reported the facility is flexible and currently allows for the following options for pick up: After parent competes sign in/out sheet, the parent can call or text to have child sent out; come to the door or enter the portable for child pick up.

Due to conflicting information from interviews and what was reported, LPA was unable to determine if Staff pulled a daycare child’s arm, used profanity or did not allow parent to enter the facility. Although the allegations may have happened or is valid there is not enough preponderance of evidence to prove the alleged violations did or did not occur. Therefore, the allegations are UNSUBSTANTIATED.

An exit interview was conducted, and appeal right discussed. A copy of this report, Notice of Site Visit and appeal rights were provided to the Site Director, Desiree Padilla. This report must be made available to the public upon request for three years
