25 | Due to COVID-19, Licensing Program Analysts (LPAs) Sharleen Robinson and Rachel Zeron conducted a Tele-inspection with Executive Director Heather Gorski and Director Maria Marquez to follow up on an unusual incident report that was self reported to the department on August 20, 2020.
LPAs scheduled to meet with the Directors via Microsoft Teams, however the Directors could not connect to the program therefore, the visit was conducted via Zoom. Per the Executive Director there were 76 preschool children in care. The Directors toured LPAs through the facility where the alleged incident occurred. LPAs conducted interviews and reviewed records.
The Director reported that on about August 19, 2020 Child #1’s Representative called the facility and spoke to Staff #1, the Representative alleged that on or about August 19, 2020 during gymnastics class in room six or in the restroom Child #2 touched Child #1 inappropriately on their backside.
During interviews it was disclosed, on or about August 19, 2020 there were 12 children (including Child #1 and Child #2) in room six participating in the gymnastics class, under the supervision of two staff members. The gymnastics class was from 9:00am-10:00am. Child #2 was only in the gymnastics class for approximately six minutes. Child #2 arrived at the facility at approximately 9:53am on August 19, 2020.
During the gymnastics class, Child #1 and Child # 2 were not sitting near each other. Child #1 or Child #2 did not use the restroom and they were not unsupervised by staff. It was also disclosed that staff have not observed Child #2 or anyone else touching Child #1 inappropriately on their backside. Staff are aware that Child #1 has expressed that their "tummy" "belly" hurt at times, if they don’t get their "special drink" each day, Child #1 has had constipation.
During children interviews it was not disclosed that Child #2 touched Child #1 on their backside inappropriately. It was disclosed that a child was touched on their legs and their backside hurt because they had to use the bathroom.
