25 | On the above date and time, Licensing Program Analyst (LPA) Susan Brewer for the purpose of continuing a case management inspection in response to a self-reported unusual incident report (UIR) received from the facility on 03/15/2024. LPA was greeted by Site Director Patricia Maciel and granted entry to tour the facility inside and out. LPA conducted a census of 50 children in care, supervised by 6 staff.
The licensee reported that on 03/14/2024, they received an allegation that a facility staff rough handled a child when they removed a child from a bike they were riding. On 04/23/2024 LPA Susan Brewer, conducted an initial inspection, made observations, reviewed facility records, conducted interviews with pertinent parties, however other pertinent parties relevant to the incident were unavailable to interview.
On today’s date, LPA S. Brewer, continued the inspection. Information gathered through Interviews with pertinent parties revealed that on 03/14/2024 a subject staff was witnessed lifting a subject child from their bike roughly in front of the authorized representative, other children and staff, which resulted in the the child being hurt on the arm and crying, but no marks observed. Other pertinent parties interviewed revealed that the staff redirected the child to stop riding their bike, to assist the authorized representative during pick-up time and no other parties present witnessed the staff rough handle the child or observed the child to be injured. It was also revealed that the facility staff was aware of the authorized representative’s presence when redirecting a subject child. The LPA was unable to obtain evidence to corroborate that a subject staff rough handled a daycare child or that an injury occurred as a result of a staff hurting a child either accidentally or intentionally. Based on information gathered through observations, record reviews and interviews conducted, the facility acted appropriately, and no violations have been identified.
No citations or civil penalties were issued.
An exit interview was conducted, and a copy of this report was provided to the Director Patricia Maciel.
A notice of site visit was issued and must remain posted for 30 days. |
