Interviews conducted disclosed a staff member (S1) was supervising children at a nearby park while Licensee left the facility to pick up additional children. During a previous visit, LPA observed the park was not fully fenced. Video footage on 09/18/2025 revealed a child (C1) standing alone at an unfenced end of the park before walking into the street while S1 was standing at another end of the park supervising the other children. It was revealed a witness retrieved C1 from the street and notified S1. Although information obtained indicated appropriate ratios were maintained by staff at the time of the incident, it is determined that S1 did not provide adequate supervision of all children in care resulting in C1 wandering into the street.
Based on observations and evidence collected, including information obtained during interviews and records reviewed, the preponderance of evidence standard has been met; therefore, the above allegation is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12, Chapter 3), are being cited on the attached LIC 9099-D.
LPA Tiffanie Diep informed the licensee, Stacie Shute, that this report dated 10/24/2025 documents one Type A citation which shall be posted for 30 consecutive days as there was an immediate risk to the safety of children in care.
Also, LPA Tiffanie Diep informed Licensee to provide a copy of this licensing report dated 10/24/2025 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgment of Receipt of Licensing Reports (LIC 9224), or other written statement, must be placed in the child’s file for verification.
An exit interview was conducted and report was reviewed with the licensee, Stacie Shute. A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
