On the date and time listed, Licensing Program Analyst (LPA) Perla Ordones arrived at the facility for the purposes of conducting a Case Management inspection in response to the receipt of an Unusual Incident Report (UIR) that was submitted by the facility on 07/23/2024. LPA was granted entry into the facility by Site Director Lubna Sohail. LPA explained the purpose of today's inspection, completed a facility tour, and obtained a census.

It was reported that on 07/19/2024, during dismissal time, a day-care child walked out of the classroom behind another family as they were leaving. LPA conducted interviews with pertinent parties who stated that at the time of the incident, one staff member was changing diapers while another was talking with authorized representatives. According to pertinent parties, both staff members realized the day-care child had walked out of the classroom when one of the staff asked where the day-care child was in order to change the child's diaper. Pertinent parties stated that one of the staff members inside the classroom retrieved the day-care child who was outside walking down the classroom ramp. The day-care child was brought back inside the classroom and the child's authorized representative was informed of the incident.

Per regulation 101229(a)(1), Responsibility for Providing Care and Supervision, "No child(ren) shall be left without the supervision of a teacher at any time". The facility was informed that supervision, including visual observation, is required at all times. Based on information obtained during the investigation, it has been determined that this is violation of Title 22 regulations.

LPA Perla Ordones informed Site Director Lubna Sohail that this report dated 10/01/2024 document(s) one Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Perla Ordones informed the Site Director Lubna Sohail to provide a copy of this licensing report dated 10/01/2024 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A notice of site visit was given and must remain posted for 30 days.

Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Based on interview and record review, the licensee did not comply with the section cited above as it was reported that a daycare child walked out of the classroom without the classroom staff members seeing which posed an immediate health, safety or personal rights risk to persons in care.
