32 | Regarding the allegation that facility staff do not prevent daycare child biting multiple daycare children: LPA observations, record reviews and interviews conducted revealed the following: Pertinent parties interviewed described witnessing a subject child biting other daycare children and that the facility staff took steps to implement a plan to prevent biting in the classroom. Pertinent parties interviewed confirm that the staff present were in ratio and made several attempts to address the incidents of biting by sending resource materials home with authorized representatives to implement a plan in the home environment and to prevent further biting incidents. Other records reviewed indicated the tools recommended were unsuccessful and the facility was unable to prevent the subject child from biting other children unprovoked, regardless of the staff efforts to intervene. In addition, the facility placed an additional staff member in the classroom to assist teachers with one-to-one shadowing of the subject child. The facility self-reported incidents of biting of a subject child identified as a habitual biter and also reported the subject child identified is no longer enrolled in the program.
Although it was revealed during this investigation, that the facility made several attempts to address the issue of a subject child biting other daycare children, by providing resources and guidance to authorized representatives and by providing one-to-one shadowing, the assistance was not received until almost 6 months after the subject child was enrolled. Facility records revealed multiple biting incidents occurred consistently and were documented from 07/19/2023 through 04/23/2023. On some occasions during this time frame, it was documented that some children were bitten twice in the same day. Therefore, based on the information gathered the allegation is determined to be Substantiated.
Based on LPA’s observations, interviews which were conducted and record reviews, the preponderance of evidence standard has been met, therefore the above allegation that facility staff do not prevent a daycare child from biting multiple daycare children is found to be SUBSTANTIATED. California Code of Regulations, Title 22, 101223(a)(2) Personal Rights is being cited on the attached LIC9099D for a Type A violation.
LPA Susan Brewer informed licensee Director Bonnie Acosta, that this report documents a Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.
