On the above date and time Licensing (LPA) Program Analyst Susan Brewer, arrived unannounced at the facility for the purpose of continuing a complaint investigation and to deliver findings into the above allegation. The LPA was greeted by the Director Bonnie Acosta and granted entry to tour the facility inside and out. LPA conducted a census of 65 children in care.

On 06/13/2024 the LPA S. Brewer initiated the complaint for allegation of a personal rights violation. The LPA conducted interviews with pertinent parties, made observations and reviewed records and more time was needed to complete the investigation. During today's investigation, LPA further reviewed facility records, made observations, and conducted interviews pertinent to the investigation.

It was alleged that on 05/30/2024 a facility staff did not treat child with equality when a staff was witnessed snatching a water bottle from a subject child’s possession and staff harassed the child on multiple occasions for having their water bottle, while other daycare children were allowed to have their water bottles on hand.

LPA interviews conducted with pertinent parties revealed facility staff temporarily removed a water bottle belonging to a subject child for misuse of the water bottle during daily activities. Information gathered during the interviews also revealed potential safety concerns for a subject child while climbing play structures, where the child needed both hands to climb and for swinging the bottle at other children coming into close proximity of the child's personal water bottle. In addition, parties interviewed revealed other alternatives of drinking water for children was freely available by drinking fountains and/or pitchers of water and disposable cups, when the water bottle was temporarily set aside. The licensee was unable to provide video footage for LPA to review alleged dates and times of incidents. Therefore, based on the conflicting information gathered from pertinent interviews and review of records, the allegation is determined to be Unsubstantiated.

Although the allegation that a facility staff did not treat child with equality may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.
