On 06/11/2025 Licensing Program Analyst (LPA) Susan Brewer, arrived at the facility to conduct a annual inspection. LPA was granted entry by Monica Maciel. LPA toured the facility, inside and out, reviewed records, and observed and/or discussed the following: The facility has two waivers on file for rotation outdoor play and commingling of school age and preschool programs during the first and last hour of operation. The licensee administrator Gayani Wedanarachchi, arrived to join the inspection at 5:30 PM.

Days and hours of operation: Monday-Friday, 7:00 AM to 6:00 PM in rooms 2, 3, 5 and 6; Napping area in detached Building #3.

The inspection consisted of reviews of the following domains: Food Service; Reporting Requirements
Physical Plant; Care and Supervision; Children Records; Staff Records; Staffing Ratio and Capacity and
Personal Rights. The inspection found the facility to be in compliance in these domains, except as noted on the LIC809D. Deficiencies were cited this visit. The licensee is asked to update the following documents, if applicable, and submit to licensing within 30 days:

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

The following items have been posted and are updated where necessary:

· The facility is not operating within the terms of the license. The facility is NOT operating within the terms of the license. The licensee was observed to commingle children enrolled in the preschool program with school age program beyond the requested and approved waiver to commingle children during the First and Last hour of operation. In addition, the LIC200A application for this license indicates children enrolled are 1st grade through 12 years of age. The licensee has enrolled 12 Kindergarten children in the school age program, with 8 in attendance and commingled with the school age children. By admission the licensee stated they will transfer kindergarten children from school age to preschool rooms as necessary.
· Ratios were met and appropriate supervision was provided during this inspection
· Classrooms are clean, free of hazards.
· No weapons stored at the facility
· A fully charged fire extinguisher (2A:10BC) was observed and checked by the fire department. A smoke detector was present and tested by the Director during this inspection; However, a detached room where children were observed napping did not have a carbon monoxide detector were present.
· There are no accessible bodies of water present. All wading pools or similar product must be emptied immediately after use and stored in an upright position.
· Medications are stored where inaccessible to children in the director’s office.
· Hazards are stored where inaccessible to children which include Disinfectants, cleaners and other items that are dangerous. Poisons and toxins are locked.
· All floors are clean and safe.
· Bathrooms were observed to be safe, sanitary, however the LPA observed a toilet and sink which were not in operating condition during the inspection. The director stated they were in the process of repairing the equipment.
· Outdoor activity areas/playgrounds are enclosed by appropriate fences, free of hazards and are supplied with age and size appropriate equipment in good condition.
· Food preparation area is clean, free of litter, rubbish and free of rodents and other vermin
· Measures are taken to keep the facility free of flies, other insects and rodents
· Food is stored appropriately and protected from contamination.

· Storage containers for solid waste, including moveable bins-have tight-fitting covers in good repair
· Menus are posted at least one week in advance in a place visible by the child’s authorized representative, dated and kept on file for 30 days, and made available upon request
· Uncontaminated drinking water shall be readily available both indoors and out and provided by water igloos, water jugs and disposable cups.
· The areas around or under high climbing equipment, swings, slides, and similar equipment shall be cushioned with material that absorbs a fall: Facility has artificial grass, sand and shade tarp.
· Sign in/Sign out record was reviewed and does not meet regulation requirements, where 2 children did not have sign in/out records on June 9 and 10, and 1 child was missing proof of sign in/out record.
· A Staff member is present with current Pediatric CPR/First Aid which expires on 08/2026
· Opening and closing staff member’s CPR/First Aid expires on 08/2026
· Director completed Health and Safety Training on 04/16/2023
· Staff qualifications and files were reviewed and are NOT complete: A staff present and supervising children did not have proof of criminal record clearance, Immunization record, TB and Health Screening. A second subject staff present, and supervising children was missing Immunization record, TB and Health Screening.
· Staff have received on the job training for housekeeping, sanitation and universal health precautions
Licensee was informed the Department has inspection authority per Health and Safety Codes.
· Children files were reviewed and are complete. Sign in/out records for 3 children present were incomplete and missing signatures and dates.
· Documentation of fire & earthquake drills to be conducted every six months: Last drill on 04/15/2025 at 10:30 AM to 10:36 AM, 38 children in care.
· Documentation of Lead Testing is on file: Report dated 05/12/2023 document no lead exceedances for outlets used to conduct food preparation and drinking water.
· A review of staff records on 06/11/2025 indicates that NOT all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
· AB2370 – Lead Exposure, day care facilities, effective January 1, 2019 –
The bill requires that all Child Care Centers, operating in a building constructed before January 1, 2010, shall have their drinking water tested for excessive lead levels, on or after January 1, 2020, but no later than January 1, 2023. Child Care Centers must thereafter test their drinking water every five years after the date of the initial test.
