On the above date and time Licensing Program Analyst (LPA) Susan Brewer made an unannounced visit to the facility for the purpose of continuing a complaint investigation and to deliver findings regarding the above allegations. The LPA was greeted and granted entry into the facility by Director Monica Maciel, to tour the facility inside and out. The LPA took a census of 25 supervised by 3 staff.

The LPA S. Brewer initiated the investigation on 09/15/2025, however more time was needed to complete the investigation. On today’s date the LPA met with Director Monica Maciel, regarding the allegations of Personal Rights and Supervision. During the investigation, the LPA Made observations, reviewed and obtained facility records and interviewed parties pertinent to the allegations.

It was alleged facility staff do not ensure that daycare child's toileting needs are being met when a subject child was observed to have soiled diapers on more than one occasion. During the investigation, the LPA obtained records, made observations and conducted interviews with pertinent parties relevant to the investigation which revealed the following: The LPA did not observe violations of staff performing duties during diaper changes while caring for children. The agency accepts preschool children requesting potty training services and there are written policy and procedures for staff performing diaper changes of preschool children. The protocols include steps for best practices in hygiene during changes in the toddler program only. Facility staff are required to read and agree to the protocols. The protocols require staff to maintain a chart. Based on record review and interview, the facility does not maintain charts for diapering in the preschool program, only in the infant and toddler program. It was also determined that the facility parent handbook and admission agreement do not mention record keeping of diaper logs for preschool children, and only requests the authorized representative provide a crib sheet, diapers and wipes for their child.

LPA interviews with pertinent parties stated diaper checks are completed on an hourly basis for preschool children. Pertinent parties interviewed did not corroborate the allegation and denied preschool children are left with soiled diapers. The LPA was unable to interview other parties pertinent to the investigation. The director denied the allegation and stated there were no diapering concerns brought to their attention. The LPA was unable to obtain specific dates, photos or documentation of the alleged incidents of a subject child left in soiled diapers. In addition, the LPA was unable to interview potential witnesses regarding the allegation due to barriers of development stages and availability. Based on LPA observations, review of records, the inability to interview other pertinent parties and conflicting statements obtained during the investigation, the allegation is determined to be unsubstantiated.

It was alleged that a staff did not provide adequate supervision resulting in a daycare child sustaining an injury caused by another child. The LPA conducted a review of records, made observations and conducted interviews with pertinent parties relevant to the investigation which revealed that on 08/29/2025 an unusual incident took place with 4 children during indoor activities. Pertinent parties interviewed described a subject staff standing in the doorway of the restroom to observe children during restroom calls while supervising children lining up in the classroom prior to transitioning the children for outdoor play. Pertinent parties stated during interviews that one subject child playing in line, fell and landed on the arm of another subject children sitting on the floor, causing the child to cry.

It was also determined that the licensee verbally reported the incident to authorized representatives, however they were unable to locate any written documentation of the incident. Following the incident, the director acknowledged receiving notification from authorized representatives that medical attention was sought for a subject child and no injury was determined at that time. The director stated on 09/10/2025 a subject child returned to daycare, at which time they were notified the child sustained an injury to the arm which required treatment. During the investigation the LPA reviewed records relevant to the allegation. Due to the lapse in time and the inconsistencies in documentation obtained from 08/29/2025 through 09/10/2025, the LPA is unable to determine if the subject child’s injury is related to the incident on 08/29/2025. The LPA determined the facility staff was in ratio at the time of the incident. During the investigation the LPA was unable to interview potential witnesses regarding the incident due to barriers of development stages in speech and availability. Based on LPA observations, review of records, the inability to interview other pertinent parties, and conflicting information obtained during the investigation, the allegation is determined to be unsubstantiated.

Although the allegations that facility staff do not ensure that daycare child's toileting needs are being met and that staff did not provide adequate supervision resulting in daycare child sustaining injury caused by another child may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED.

No citations issued for the investigation. See LIC809 Case Management Evaluation Report generated on today's date documenting a deficiency cited for a Type B violation.

No Civil Penalties Issued.

Exit interview was conducted and a copy of this report was provided to Director Monica Maciel.

A notice of site visit was provided and must remain posted for 30 days.
