32 | Per licensee’s own admission, she and her assistant(s) attend to all the children needs that required constant supervision, however, she was unable to please all parent (s)/legal guardian(s)according to their own personal standards. Licensee acknowledged incident(s) brought to her attention regarding a particular child (Child #1). During the physical inspection at the facility LPAs observed multiple children very close in age demanding immediate attention from the licensee which makes care and supervision complicated for her and assistant(s). Interviews revealed that a parent/legal guardian of Child#1 who is no longer in care had a disagreement with the licensee regarding the care that she was providing to his/her child and requested that child ( Child#2) be disenrolled from the facility due to the alleged statement of inappropriate interaction between Child#1 and Child's#2. Licensee stated that she felt challenged and defeated by the situation, but she talked to parents and children to reconcile differences, and to clarify the situation. Children involved in the incident are close in age, play and associate together during daycare hours. Licensee disclosed to both parties that she will not disenrolled any of the children involved in the alleged incident. Licensee stated inappropriate behavior is never permitted at the facility and children with behavioral issues are redirected to positive activities. Licensee denied children engaging in inappropriate interaction with each other. Child(ren)interview(s) disclosed that Child #1-Child#4 were playing in the "playroom" adjacent to the living room when Child #3 pulled his/her pants down and persuaded other children to do the same. All children are preschool age, licensee observed the incident few minutes after it happened and the parents of children involved in the incident were informed of the issue. Child#1's parent(s)/legal guardian(s) decided to disenrolled his/her child the same week that the incident occurred. Multiple visit were made to interview all children involve in the incident; however, not all children were present and/or available for interview. In addition due children age this department was unable to clarify all the information reported. Licensee, Rana Abdraboh acknowledged the incident as an accident and understand the importance of children's Personal Right and Active Supervision. Based on the information obtained during the investigation, there is conflicting information regarding the allegation. Although allegation may have happened or is valid, there is no preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore allegations are deemed Unsubstantiated at this time. An exit interview was conducted, and a copy of this report was provided to facility by licensee, Rana Abdraboh. A Notice of Site Visit was given and must remain posted on, or immediately adjacent to the interior of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. THIS REPORT MUST BE AVAILABLE TO THE PUBLIC, UPON THEIR REQUEST, FOR THREE YEARS. |
