32 | Interviews with pertinent parties revealed the facility currently has 15 children enrolled, with 8–10 children attending daily, including part time children. Title 22 regulations do not limit the number of children who may be enrolled in a family childcare home; however, no more than 14 children may be present at any one time, and when more than eight children are present, an Assistant must also be present. The complaint included information regarding the Assistant’s work schedule; however, interviews yielded inconsistent reports. No specific dates, times, or documentation were provided to demonstrate the Licensee operated over capacity or without the required Assistant. The LPA reviewed sign in sheets; however, the Licensee stated not all children are consistently signed in or out. Title 22 currently does not require family childcare homes to maintain sign in/sign out records.
Due to conflicting information and lack of supporting documentation, the LPA was unable to determine whether the Licensee was ever alone with more than eight children present.
It was also alleged the Licensee does not ensure daycare children are properly fed while in care. Specifically, regarding portion sizes being too small and when children request additional food, the Licensee reportedly tells children that lunch would be served soon, even when lunch was still several hours away.
Title 22 regulations do not specify exact portion sizes for meals and snacks in Family Child Care Homes. However, when a Licensee chooses to provide food, sufficient meals and snacks must be offered to support children’s Personal Rights and ensure their basic needs are met.
Interviews revealed that children are provided breakfast upon arrival, which may include pancakes, cereal, toast, fruit, and milk or water. A morning snack is served at approximately 10:30 a.m., and lunch is served around 12:00 p.m. Lunch items may include pasta, sopita, rice with ham, or pizza, along with fruit and milk or water. An afternoon snack, like the morning snack, is provided after nap time. |
