On June 26, 2026 Licensing Program Analysts (LPAs) Elyse Jones and Eric Ramos arrived at the facility to deliver findings regarding a complaint investigation. LPA conducted a tour of the facility inside & outside, conducted interviews, and obtained documentation.

On April 29, 2026, the Department received a complaint alleging the Licensee was operating beyond the terms and conditions of the license. Specifically, it was alleged the Licensee had been observed caring for up to 13 children, with nine reportedly enrolled. It was further alleged the Licensee was observed supervising a group of children outdoors while an Assistant supervised another group indoors. At other times, the Licensee was reportedly supervising all children while the Assistant prepared meals inside, and the Licensee occasionally stepped away from the immediate childcare area to answer phone calls or complete other tasks. Although concerns were raised regarding supervision practices, no specific incidents of lack of supervision or harm to children were reported.

Interviews with pertinent parties revealed the facility currently has 15 children enrolled, with 8–10 children attending daily, including part time children. Title 22 regulations do not limit the number of children who may be enrolled in a family childcare home; however, no more than 14 children may be present at any one time, and when more than eight children are present, an Assistant must also be present. The complaint included information regarding the Assistant’s work schedule; however, interviews yielded inconsistent reports. No specific dates, times, or documentation were provided to demonstrate the Licensee operated over capacity or without the required Assistant. The LPA reviewed sign in sheets; however, the Licensee stated not all children are consistently signed in or out. Title 22 currently does not require family childcare homes to maintain sign in/sign out records.

Due to conflicting information and lack of supporting documentation, the LPA was unable to determine whether the Licensee was ever alone with more than eight children present.

It was also alleged the Licensee does not ensure daycare children are properly fed while in care. Specifically, regarding portion sizes being too small and when children request additional food, the Licensee reportedly tells children that lunch would be served soon, even when lunch was still several hours away.

Title 22 regulations do not specify exact portion sizes for meals and snacks in Family Child Care Homes. However, when a Licensee chooses to provide food, sufficient meals and snacks must be offered to support children’s Personal Rights and ensure their basic needs are met.

Interviews revealed that children are provided breakfast upon arrival, which may include pancakes, cereal, toast, fruit, and milk or water. A morning snack is served at approximately 10:30 a.m., and lunch is served around 12:00 p.m. Lunch items may include pasta, sopita, rice with ham, or pizza, along with fruit and milk or water. An afternoon snack, like the morning snack, is provided after nap time.

The Licensee stated that if a child requested additional food close to lunchtime, she reminded the child that lunch would be served shortly and offered an alternative option, such as a banana, or asked whether the child preferred to wait. According to the Licensee, children often chose to wait. Children interviewed confirmed they were sometimes told to wait for lunch but stated they were not left hungry and could receive more food during meals or snacks upon request.

During the inspection, the LPA observed both snack time and lunchtime routines. Children who requested additional servings were provided with more food by either the Licensee or the Assistant. After children indicated, they were finished eating, they transitioned to play activities until all children were done and prepared for outdoor playtime or nap routines.

This agency has investigated the complaint. The Department was unable to determine exactly how much time passed between meals or how much food each child was given or served at each mealtime. The Department was also unable to determine whether the Licensee was ever alone with more than eight children present. Based on the conflicting information obtained, interviews conducted, documentation reviewed, and the inability to clarify key details of the complaint, the allegations are found to be UNSUBSTANTIATED. A finding that an allegation is unsubstantiated means that although the allegation may have happened or may be valid, there is not a preponderance of the evidence to prove the alleged violation occurred.

No deficiencies cited at this time.

A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
