32 | Additionally, the Director further explained that, in some cases, the concerning behaviors ceased for extended periods after being addressed with the child’s Authorized Representative(s), before new behavioral issues emerged. Administration reports that they are following the facility’s Discipline Policy as outlined in the Parent Handbook and have provided resources to the child’s Authorized Representative(s).
During the initial inspection, two recent incidents involving similar inappropriate behavior were identified. In both instances, Administration was observed to have followed appropriate procedural steps in response. However, despite administrative compliance with disciplinary procedures and cooperation from the family, the facility does not have a comprehensive or proactive plan in place to prevent recurrence of inappropriate behaviors within the classroom. As a result, this lack of a preventative strategy poses an ongoing risk, and children’s rights to a safe environment are being violated.
Based on all the information disclosed from pertinent parties and the documentation received, the department has determined the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED.

A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
