32 | corroborate the source of the scratches or determine whether they occurred while the child was in care.
Regarding the allegation that the Licensee engaged in an inappropriate conversation with other adults in the presence of children, it was specifically reported that the Licensee was approached by a parent regarding scratches on their child’s face and, during the conversation, became disrespectful and began yelling in front of the children. Interviews revealed that on the day of the incident, C1’s guardian arrived during lunchtime while C1 was covered in spaghetti. During the interaction, the guardian demanded explanations regarding the scratches from both the Licensee and other children present. Interviews further indicated that the Licensee ultimately asked the guardian to leave the premises due to what was perceived as aggressive behavior. Due to conflicting information received, LPA was unable to corroborate who engaged in the inappropriate conversation.
Regarding the allegation that the Licensee failed to provide adequate supervision, confidential interviews indicated that children were supervised at all times. LPA Peebles observed that there were no areas within the home where a child could be out of view or able to injure another child without staff awareness. The Licensee was reportedly present throughout the day and continuously monitoring the children. When the Licensee needed to prepare meals or complete other tasks, an assistant residing in the home was available to maintain supervision.
Based on the information obtained during the investigation, there is insufficient evidence to support the allegations that a child sustained multiple scratches while in care, that the Licensee failed to provide adequate supervision, or that the Licensee engaged in inappropriate conversation in the presence of children. Although the allegations may have occurred or may be valid, the evidence does not establish that the alleged violations did or did not occur. Therefore, the allegations are deemed unsubstantiated.
An exit interview was conducted with Licensee Laura Rodriguez. A copy of this report, appeal rights, and the Notice of Site Visit were provided. The Licensee was reminded that the Notice of Site Visit must be posted in a visible location within the facility for 30 days.
