32 | Additionally, three of three confidential interviews corroborated that C1 was seen wandering alone in the parking lot, approximately 50 yards from the CCC playground fence, before being escorted back to the facility. Due to conflicting statements, the exact duration C1 was unsupervised could not be determined; however, it was confirmed that C1 was returned to the CCC office at approximately 4:45 PM.
The complaint also alleged that staff failed to comply with reporting requirements by not notifying Community Care Licensing (CCL) of the incident. A review of records confirmed that an Unusual Incident Report (UIR) was drafted; however, neither interviews nor documentation could confirm that it was submitted to the correct CCL regional office. Interviews and records indicate that CCC has a history of submitting detailed UIR's in a timely manner via telephone and email and independently following up on incidents. On January 17, 2025, two days after the incident, CCL staff conducted a separate inspection at the CCC, but staff did not report the incident to the LPA at that time.
Based on confidential interviews and record review, the allegations that staff did not provide adequate supervision, resulting in a child wandering away from the facility, and that staff failed to comply with reporting requirements, are substantiated. The preponderance of evidence standard has been met.
The facility is in violation of Title 22, Section 101229(a)(1): Responsibility for Providing Care and Supervision, which poses an immediate risk to the health, safety, and personal rights of children in care. Absence of supervision is considered a zero-tolerance violation within CCL and is classified as a Type A deficiency due to the immediate risk posed to C1. A civil penalty of $500 will be assessed.
Additionally, the facility representative must post and provide copies of the Type A deficiency report to all parents/guardians of currently enrolled children by the next business day. Copies must also be provided to parents/guardians of newly enrolled children for the next 12 months. The CCC may not substitute an independently written report—the original CCL report must be provided. The licensee must maintain a signed Acknowledgement of Receipt (LIC 9224) form in each child’s file.
