32 | During one incident the child climbed on top of a play kitchen and staff picked up the child in order to prevent the child from injuring themselves. Once picked up and brought back to the ground, the child started to have a temper tantrum and began kicking the staff member and flailing their arms and legs. In order to keep the child and other children free from harm, the staff member picked up the child and brought them to the front office. It was disclosed that the child was handled in a rough matter, however several interviews confirmed that the child was being challenging and staff struggled to get the child to calm down. Therefore, the child was carried away by a staff member with the intentions of preventing harm to the child and children in care. Throughout the course of the investigation LPAs were unable to conduct interviews with all pertinent individuals.
Based on information obtained during this investigation through interviews conducted, the review of pertinent documentation, and after receiving conflicting information, the allegation is UNSUBSTANTIATED. A finding that the allegation is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the allegation occurred.
An exit interview was conducted with the Director, Appeal Rights were discussed and issued, a copy of this report was provided, and a Notice of Site visit was issued.
The Notice of Site Visit (LIC 9213) shall be posted where the parent/guardian of children enter and exit the facility.
The Notice of Site Visit (LIC 9213) must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.
A copy of this report must be made available for the next three years. |
