On this date and time, Licensing Program Analyst (LPA) Laura Mejorado arrived at the facility to deliver the findings of this complaint investigation which was initiated on 3/14/25. LPA met with Director Belen Acosta. LPA toured the facility, took census, and discussed the following with the Director.

During the investigation, LPA made observations, reviewed pertinent documentation, and conducted interviews with pertinent parties. It was alleged, staff are operating out of ratio, staff did not provide adequate supervision resulting in day-care children hitting each other, staff restrained day-care children in care, and staff left a child unattended.

Staff are operating out of ratio
It was reported, staff are operating out of ratio with 30 children being supervised by 2 staff. A census was conducted during visits to the facility on 3/14/25, 4/15/25, and 5/2/25, where facility was found to be operating within ratio. However, due to conflicting information while conducting the investigation this allegation is unsubstantiated.

Staff did not provide adequate supervision resulting in day-care children hitting each other
It was reported, children were fighting and throwing toys at each other due to there not being enough staff to supervise. While conducting interviews it was disclosed that due to the children’s ages, they will sometimes throw toys, but staff will intervene and redirect the children. However, due to conflicting information while conducting the investigation this allegation is unsubstantiated.

Staff restrained day-care children in care
It was reported, a staff member was restraining children to their cots during nap time. It was alleged the staff member would put their legs on the children to keep them in their cots and ask them to take a nap. While conducting interviews staff denied the allegation and disclosed if a child does not want to take a nap they are asked to stay on their cots and given a quiet activity. However, due to conflicting information while conducting the investigation this allegation is unsubstantiated.

Staff left a child unattended
It was reported, a child was left unattended in a hallway. Based on interviews conducted while a class was transitioning to outside play a child was found in the hallway and brought to the front office by staff. The child was kept in the front office until their assigned teacher realized the child was missing and contacted the front office. Interviews disclosed it took about 20-30 minutes before the assigned teacher realized the child was missing and the teacher was then terminated. However, due to conflicting information while conducting the investigation on whether the child was left unattended, this allegation is unsubstantiated.

Based on information obtained during this investigation through interviews conducted, the review of pertinent documentation, and after receiving conflicting information, the allegations are UNSUBSTANTIATED. A finding that the allegation is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the allegation occurred.

An exit interview was conducted with the Director Belen Acosta, Appeal Rights were discussed and issued, a copy of this report was provided, and a Notice of Site visit was issued.

The Notice of Site Visit (LIC 9213) shall be posted where the parent/guardian of children enter and exit the facility. The Notice of Site Visit (LIC 9213) must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.

A copy of this report must be made available for the next three years.
