On the date and time listed above, a case management visit is being conducted in response to the receipt of an unusual incident report (UIR) from the facility. The UIR was received by the licensing agency on 07/13/22. It indicated that children touched each other inappropriately outdoors on the playground in a hidden area.

A prior visit was conducted on 7/22/22 and on that visit, LPA reviewed records, obtained photos and conducted interviews. During today’s visit additional interviews were conducted.

LPA interviewed 3 staff and the Director. Staff interviews reported teachers are required to be mobile during outside play and there are no hidden areas on any of the playgrounds. Staff interviews also reported due to young age, children sometimes hug each other when saying hello or good bye but not in an inappropriate (sexual) manner. Staff stated children are redirected if they try to kiss someone and that children have stated kissing is for 'mommies and daddies'. Staff stated they teach personal space boundaries including following best practices to encourage social distancing due to COVID. Staff stated facility policy requires the Director to follow up and discuss with parents concerns of any children engaging in personal boundary or aggressive behaviors.


Director interview stated facility self reported due to Parents reporting C2 touched C1 outside in a hidden area after parents noticed a rash by C1's mouth and asked C1 are you kissing your friends again. Director stated C1 does try to kiss others sometimes but is redirected

Director also reported cameras are used to provide extra monitoring from the Directors office for classrooms and all outdoor play areas during hours of operation. There are no hidden areas on any of the playgrounds; and due to see through fencing all playgrounds are easily viewed. Staff and Director interviews denied observing any inappropriate touching indoors or outdoors, any child reporting inappropriate touching and confirmed there are no hidden areas outdoors as reported.

Regarding children interviews, C2 stated they did tickle a child on top of the head. C2 and C3 stated no to anyone kissing them and denied being touched or touching other children in the genital area. C2 also showed LPA and Director where they play outdoors on the castle (play structure). On 7/22/22, LPA attempted collateral interview for C1 however Parent declined interview on 07/26/22 and did not provide any information.
During tour of the outdoor play area, LPA observed and obtained photos of open playground including play structure with no hidden areas, and see-through chain link fencing.
Based on information gathered from interviews and records, the facility acted appropriately, and no violations have been identified. Facility completed reporting requirements as required by CCR regulations for UIRS (Telephone notification to Duty Officer and submission of LIC624) to the Department of Social Services. Facility maintained staff to children ratios for supervision and provided additional corporate contacts to parent to follow up their concern.

An exit interview was conducted, and LPA Carbullido provided the Director Belen Acosta with a copy of this report, appeal rights and notice of site visit during today’s visit.
