25 | On August 15, 2023, at 10:31 AM, Licensing Program Analyst’s (LPA’s) Anastasia Flores and Lorenia Valenzuela arrived for the purpose of conducting interviews in regard to a previous complaint dated 7/11/23. LPAs toured the facility inside and out and took a census. LPA Flores observed there to be missing documents in four out of five staff files, see attached 859. LPA’s file review resulted in three staff not associated with the facility and one staff background clearance has not been completed. LPA’s interviewed Interim, Director, Yessenia Argueta who stated she believed the facility had thirty days to gather all documents once the staff were hired. On 7/31/23, LPA Flores informed Interim, Director, Yessenia Argueta, the director packet needs to be submitted within 10 days of her being hired with the facility, Ms. Argueta stated she sent the forms via fax and email on 08/09/23, no records have been received via email as of 8/15/23. This case management is in result of files being reviewed during inspection. The facility is being cited for 101216(g)(1) Personnel Requirements, 1596.8662 (b)(1) health and safety, and 101170(e)(2) Criminal Record Clearance.
An exit interview was conducted and a copy of this report, 809D’s, LIC859 (staff record review) and appeal rights was handed to Interim Director, Yessenia Argueta. Interim Director was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.
A notice of site visit was provided, and licensee understands it must remain posted at the facility for the next 30 days. |
